Docs with wrong dates

Lately, I've had a lot of LO's and SS call me with some story about how a closing got postponed a day or two, but they don't want to redate docs....so will I still do the closing and "backdate"...including the Right to Cancel. I tell them no way and they get mad and go on to the next notary.....have you been running into this lately?

I've had those calls before. Get the name of the caller, and the company, and turn them in. It's TOTALLY ILLEGAL, but I have no doubt that they get it done because I had one that offered me $500 for a $125 closing one time. I figure it got done, but I turned them in.

Sometimes on a split signing I have had conflicts on the RTC. I just tell those folks that MY docs are going to be signed with the DATE of the CLOSING, period, and if the expiration on that RTC is wrong, we will correct that at the closing table and initial it with the correct expiration.

As for the acknowledgment, there's NEVER any question on that in any way. You sign today, you put today's date in.

You did absolutely right, but it's only your legal duty. That's what we do!

Very frustrating. I was very excited to actually get the docs a day prior to the closing. Printed both copies and noticed wrong spelling. I hope I get an additional print fee. It's an RM to boot. All part of the job I suppose.

Always check docs before printing

Whenever possible, it is advisable to preview the documents before printing, checking for things like dates, spelling (names and addresses), inclusion of all documents (e.g. Exhibit "A", the legal description), etc. It may save time, paper and toner in case new documents need to be prepared. I try to review all packages as soon as possible to allow time for redrawing if necessary without affecting the appointment time.

I had a RM closing about a year ago that had the borrower's name spelled incorrectly (or so I thought at the time). I discovered this when I called to confirm the closing with him. When I speak to the borrowers regarding the ID requirement I ask them to tell me exactly how their names appear on the ID they will be using.

It turned out that the property was still titled in the names of his deceased father and mother. The closing was postponed so the estate could go through probate, but I don't think he ever completed the transaction, at least not with that lender.

I usually check the county property tax appraiser's web site to confirm that the names and address match what I see on the loan docs. In this case, it saved me the cost of paper and toner as well as the time I would have wasted on the trip only to discover the issue at the table. The TC was very appreciative, but the LO was probably not happy since he lost out on his commission.

As it turned out for me, it was an incorrect spelling on the name affidavit and confirmation I recieved. Doc's ended up being good. Thankfully.
