Notarizing Post dated docs

I have done several signings for Platinum Signing Services(New Millennium Title) Maplewood, Mn. Have been paid on time and fairly. However in Late April 2009 I was asked to Notarize some documents on Sat. that were dated for the next Monday. (this was a refi with Note, Mortgage, etc.) I refused because of the training I have had to become certified states not to do it. The gal who called me thought it was no big deal. They said they would find someone else to do it. Any input on this.

Were they asking you to notarize for Saturday's date or for Monday's date?

They wanted me to notarize for monday's date, because the signers were going to be out of the area most of the week.

Since they asked you to meet with borrowers on Saturday, but notarize for Monday's date, then you were absolutely right to refuse!

IF they had asked you to meet with borrowers on Saturday and notarize for Saturday's date, then I would have done so had it been me. As Bob_Chicago stated I would not have concerned myself with the date of the docs at that point. However, you already clarified that this was NOT the case. You did the right thing IMHO.

Agree that post dated dox, may be a problem, but it is NOT

your problem
So long as your notarizations are as of the date that the bwrs actually
sign (or acknowledge) the dox in front of you, you are ok.
Remember, we are notarizing signatures, not the content of the
document that is being signed.
Unless there is some specific prohibition in your state's notary laws,
you should have done the deed.

all the docs were dated for the 20th but the signing was to be on the 18th and notarized on the 18th.

I only notarize documents one day of the week.

I notarize documents today.

I don't notarize them tomorrow and I sure as hell don't notarize them yesterday.

Now the bank can put any date on those docs their little heart desires. We'll fix it on the RTC (which they need right anyway) other than that, I just mention to the borrowers "These docs are dated X/X/X that's no problem as long as it doesn't bother you, we'll put today's date wherever you sign and on my notary certificates."

I've never had a borrower objection or document rejection.

KISS It's not that tough... but when I sign that affidavit/acknowledgment form you can bet your last dollar that the signers little butt was before me on the date of the cert.
