Split Signing

Please help! I am about to go out on a signing. It is a split. I have never done on before. What should I be sure to do?

Check your certificates to ensure ONLY the signer's name is provided. Many notaries, including myself, will write "--ONLY--" after the signers name within my certificate, be it an acknowledgment or jurat.

Nothing different in a split signing than in any other normal loan signing except you will only be dealing with some of the signers (usually, just one). Pay close attention to the shipping instructions. Many times, if you are the first signing in the split, the title company will want you to send the documents directly to the second notary.

Without a doubt take PAW's advice and make sure that you write "only" on the person that you witnessed. I had a title company call me to say that my stamp did come through on a mortgage and I demanded for them to send it to me. My stamp was there however, so was a name that I did NOT witness. So be carefuel when it comes to that. Also double check where to send the docs. Sometimes it is to the next notary.

§ 115.5. Filing False or forged documents relating to single-family residences; punishment; false statement to notary public
(a) Every person who files any false or forged document or instrument with the county recorder which affects title to, places an encumbrance on, or places an interest secured by a mortgage or deed of trust on, real property consisting of a single-family residence containing not more than four dwelling units, with knowledge that the document is false or forged, is punishable, in addition to any other punishment, by a fine not exceeding seventy-five thousand dollars ($75,000).

Perjury is punishable by imprisonment in the state prison for two, three or four years.
§ 470. Forgery; signatures or seals; corruption of records

• (d) Every person who, with the intent to defraud, falsely makes, alters, forges, or counterfeits, utters, publishes, passes or attempts to offer to pass, as true and genuine, any of the following items, knowing the same to be false, altered, forged, or counterfeited, is guilty of forgery: … or falsifies the acknowledgment of any notary public, or any notary public who issues an acknowledgment knowing it to be false, or any matter described in subdivision (b).

§ 473. Forgery; punishment
Forgery is punishable by imprisonment in the state prison, or by imprisonment in the county jail for not more than one year.

Re: Split Signing. You might want to check to RTCs in

the package. It may be necessary to make a few extra copies for
you bwr to sign and to keep. . Each signer has their on RTC date computed from the
date that they sign and receive their RTC and TIL copies.
RTC date for 1st singer may be longer than ususal.
If you have second signer and there are no copies of the dox for your signer ,
then you will need to make copies of at least the RTC (2) and TIL/itemiztion for your
signer.
If you note an error by the first NSA, then it might be a good idea to attach a short
note, so that they do not think that you made the error .

Unless it's a purchase "split", where one title company is doing buyer's side and another is doing seller's side. In that case, it's a whole different ballgame and one nobody should play unless they really know who's on first. =O

I frequently do split borrower signings for truck drivers on the road for their home refi. The package is usually sent to a second notary who attends to the co-borrower. Usually the docs are prepared for the state where the property is held, so I'll attach a loose certificate to docs that my signing was in Oklahoma. That identifies who I am notarizing.
