I was called to do a closing tomorrow. When I just got the docs they are all dated for the 26th of May. I was sent a note saying to only change the date on the rtc.
I know that my venue has to be for the 30th.
I am going to have them date next to their signature the 30th.
Should I just have them date for the 26th? As long as my venue is for the 30th I shall be ok.

I did email and call the title company no answer.

No...think you're okay..

Change the dates in the RTC as instructed....don't change the dates on any other docs....have signers sign and date for the 30th and notarize for the 30th and you're good to go. Will look strange to have them date next to the signature the 26th and your notarization is the 30th..no?

I agree with Linda also. It's not unusual for docs to be good for several days.
Don't change any dates except the RTC with appropriate dates. They will sign & you will notarize for the 30th. They didn't ask you to backdate, TG.

"Post dating" only refers to your notary certificates. They MUST BE DATED CORRECTLY it's notary fraud to back date.

The RTC and the TIL must be dated correctly because otherwise the BO could actually rescind the loan. The TIL matters because it's one of the dates mentioned on the RTC.

Other than that, nobody cares. You just tell the borrowers " these docs were prepared and dated 5/26 but that's not a problem as long as it's okay with you.


I only notarize one day of the week... today.

The TIL is dated - they sign and insert date they signed...that's it....the RTC states you have 3 days from the LATTER of (1) the date of the transaction; (2) the date they receive the NORTC or (3) the date they receive the TIL....don't go messing with the TIL...

Not to mention - the written instructions are to change the dates on the RTC...only....no mention made of changing dates on the TIL...the OP should just do what they're told - no other date changing - changing the TIL could jeopardize the funding of the entire loan.

I think we actually agree...

I meant that when they sign it and "insert the date they signed" as you said, that date must be accurate.

Do most TIL's even have a date besides the date on the signature line? You're right, if it does I wouldn't change it... just makes sure the date signed is the actual date signed... like you said.

My general point was that the date really only matters on RTC, TIL (because of it's relation to the RTC,) and notarizations.

Nobody cares about the rest of the dates.
