DOT..Never did one like this before..Question

I have a signing tomorrow. Duel signing they are calling it. I received the docs today for my signer with a note in the body of the email. The Title person wants me to have my signer send the NOTE FedEx to the other signer, so it can be sign by the other borrower. I called her and talked to her. She tells me she messed up and both signers are signing on the same day and at the same time in different places. She is trying to fix the paper work so everything works out. So I ask her if she wants me to Fed Ex the DOT also to the other borrower so they sign on the same page too. She says no that she will just add the 2 signature pages to the DOT and the 2 ACK'S and it will record fine. She says that the NOTE is the only document that needs to have both signatures on the same page. Here is my question. Has anyone ever ran into this kind of fix before and do you think it will fly. I will do what I am ask, just seem a bit odd to me right now. Any input would be nice.

You're not notarizing the Note anyway, so give 'em what they want.

You are right . It is a no brainer to do what she asked. That is already worked out. I just am "wondering" if it will record with 2 signature pages and has any one did a signing like this before. I know if it doesn't work I will be sent back for a fix. Just asking if it will work? Tks for your input.

In a word--yes.

This is normally called a split signing. Two or more people signing in different locations.
Yes, it's done every day and yes, the DOT/Mortgage will record everywhere.

I guess I will find out if you can take a signature page form one DOT (w/ack) and add it to another DOT that has been signed and it will record. (btw) Title said it is a duel signing. They are both signing a set of loan docs each, at the same time in two locations. She said that was the problem she was trying to fix. They are not signing the same loan in 2 different locations. Thank you for your input.

I've come across a very similar situation in the past and IMO, duplicate originals are accepted.

Why should you care??

The note is not a document that has to be notarized, so it's not an issue for you. Just do what they ask, and don't worry about it - split signings are not uncommon.

BTW, it's a DUAL signing.... a "duel" signing could mean they're fighting over who signs first - interesting concept, but probably not the case here Smile

My question is: There is going to be 2 DOT's signed. 1 signature page is going to be taken from signed DOT and be added to the other DOT. Title is going to filed in the court house as a correct DOT. Will it fly. I have never seen this before and was just wondering that all. Tks for all your input.

If there are ten signature pages it will still record

if there are enough acks to cover all of the signatures and the recording fee is paid.
