Quick Claim Deed to remove name from Deed in FL
I have been ask to do a notary of a "quick claim deed" for land in FL. My client was married and they lived /had a residence/homestead in Fl. Her ex still lives in that house. He wants to refi it. They want to remove her name from the deed. His "real estate" people have sent her a "quick claim deed" to accomlish this. Is this OK or do the need a Warrenty Deed. You can call me at 817-594-0440

The first thing you need to know is how to spell it. It is Quit Claim Deed, not Quick. Sorry, but you need to know this.

This really isn't personal to you, AS, ... but it's a good example that we can use because this is one of the most common, and grating, errors made in our field. You don't "do a notary" -- at least, that's not the phrase you should use when referring to performing a notarial act.
In this case, the proper phrasing would have been, "I have been asked to notarize a quit claim deed for land in Florida."

Good lessons!
To some, all these points may sound like nitpicking, but I think it is anything but. To someone in the industry, these little details can make you look like you don't know your business. We are in a detail-oriented business, so details count. We notarize signatures. We don't do notaries... (well, most of us, anyway.) [Enough has been said on that point! ] Even though someone at a title co or ss might get it wrong, WE should always get it right, imo. So, A S, thanks for providing the opportunity for another "teachable moment" for those who need it!

Yes, a QCD **may** be sufficient. It is not up to anyone by the title company to determine whether or not a Quit Claim Deed or Special Warranty Deed or any other kind of deed is required.
Be sure to have TWO witnesses, witness the execution of the deed. The notary may act as one of the witnesses. Also be sure that the witnesses PRINT their names legibly beneath their signature.

He apparently has "people" that have helped him figure out what's needed. All you need to do is notarize the document provided when the signer shows up. If the document doesn't accomplish what he wants it to, he can go back to his "people."

Have to chime in: A S "Sid" Johnson is my good friend.
Meet Sid.
He's got one, and maybe two, college degrees and he's probably read more books than 90% of those of us on the forum. I know him personally...face to face personally.
Yeah, he said, "do a notary" and I'll tell you why he said it...he knew better but he's got a full time business he's running that keeps him stepping and fetching like a one-armed paperhanger. He doesn't slow down sometimes enough to type plainly what he means--I'll give you that, but don't sell him short. I can also tell you he knows that it's Quit Claim and not Quick Claim...his brain/fingers just made an error. I don't care if you believe this or not. I know. That's just Sid.
And, he's also a Texan, one of the last of the original good ol' boys, part of my network, a gentleman (most of the time) and he would give you the shirt off of his back. I guarantee you, even though he lives four hours away, if I called him and said I needed a tire changed before work in the morning he'd load up the missus and be here in the middle of the night to get me up and running again --without questioning.
He may not be a "speller" or a great writer but he's plenty smart. I just had to say that. I know that Sid's posts are "unique" sometimes but don't ever think he's not a good notary and somebody that you'd be glad to have as a friend. Some people just don't make it a priority to "write" as well as they perform.
FWIW, there it is in a nutshell: The person I know as A.S. "Sid" Johnson.
You can go back to your regular programming.

Seriously, though... I can tease since I married somebody just like that.
We all make mistakes. I'm the first to admit it myself... I'm a horrible typist and I don't always catch my mistakes on forums before hitting that "post" or "submit" button. I think everyone pretty much understands what I mean, though. I know I wasn't trying to be mean to him at all... but I know that a lot of notaries... even potential notaries... are reading here and may not know the proper terms.

I doubt that Sid even flinched.
But, I just know that the way he comes across on the forum doesn't do his true personality justice and he'd never say anything in his own defense. One thing I also think is good about Sid, he seems very teachable. His wife has him well trained!
I take note of that. I need to be more teachable. It's something I am working on in my personal development. I have observed that the ability of "mature" people (read: over 50) having an effect on society depends on their willingness to learn. The more gray hair I get the more I work on MAKING myself be a teachable person, 'cos it ain't easy sometimes. LOL.
Marian, you're right. It's the Texan thing, I think, and yes indeed...we do need to be clear for posterity!
