Re: Is Utah a spousal state?
Ten states - Alaska, Colorado, Hawaii, Kansas, Minnesota, Montana, North Dakota, South Dakota, Utah, and West Virginia - have adopted the definition of an "augmented estate" as used in the Uniform Probate Code (UPC). Thus Utah could be considered a "spousal state". However, the determination of whether or not a non-obligated spouse would need to sign the "legals" is a decision that must be made by the title company.
Some states, such as Utah, expressly stipulate that spousal support will be awarded to prevent a displaced homemaker from essentially becoming a "ward of the state," reliant on public assistance. Not only that, but Utah courts apply the "quality of life" standard to ensure that a displaced homemaker does not suffer a dramatic decrease in living standards.
