Lender's Instructions and Faxbacks...

OK, I'm curious how many of you are printing or not printing Lender's Instructions. Some are 25 pages! I have a notary friend who says she never prints them and nobody has ever said anything.
Also, faxbacks...do any of you just not bother with these? If so, what are the repercussions? They have become so annoying...

For the 25 page deals (now BofA, were CW) I print them for the signing package, and clip them at the back. I do not make a copy of the borrower & do not fax them.

I too print the lenders instructions to send back with the loan package.
For faxbacks, I call the contact after the signing to let them know everything was signed and the tracking # for the loan package, I then ask if they would like me to fax anything back. Most times I am not required to fax anything back, but I certainly ask them and will fax back if necessary.

I agree with the others that have responded about the closing instructions for B of A...CW... docs. I, too, print only those for the return package and yes, it's about 26 pages. Do that, but don't print that for the borrower.

On the fax backs....i really, really think that unless it's a table funding, there is no reason for the fax back. And, the number of pages to fax back is REALLY debatable......some want 25-50 pages, including ALL the mortgage, etc...

I had problems getting through to a ss and tc to send faxbacks on month end....tc was in Florida and I knew they wanted to record early (I'm on the west coast). I was up half the night trying to get through on various numbers.....then had to get a couple hours of sleep before I got up at 5:30 am to refax.....called the SS and they said that anytime there is such a problem please call them and let them know.......too bad their instructions had nothing but verbal warnings for NOT faxing back. Then got a hold of the TC...they said they really only needed the HUD and DOT to record. I had a sleepless night...i don't think they did....

just our horror stories as notaries trying to do what's best ......

There was one co. that always wanted faxbacks on CW loans. It's nonsense really.
About the only requests I get for faxbacks are for purchases or structured settlements (faxbacks for funding).

You really do this? That just seems like such overkill to me, creating extra work for yourself and volunteering for even more extra work. If they want faxbacks, they'll tell you, there's no reason to ask them if they want them. And unless they specifically ask me to, I'm never going to waste time calling the hiring company just to tell them that the signing is done. I just invoice them in whichever way they prefer and that takes care of it.

CaliNotary, I don't consider this extra work

many of the companies that I work with want a call back after the signing and a few ask for faxbacks. This is not something I decided to make up on my own.
Since I'm making the call, I ask if they need the faxbacks. Yes or No, I do what what they want.

Same as an invoice, some need it, some don't. I don't send one unless it's required.

Anything and everything I get from a lender and title company (except explicit instructions to me) is duplicated and given to the borrower(s). This includes closing instructions if the original file had them. I have been advised that removing or inserting documents into the package may be construed as UPL. Granted, not including the closing instructions may not be too disastrous, but "if you didn't include them, what else didn't you include?"

I don't review them with the borrower(s) but do point out that their package contains "extra documents" that they may wish to review during the rescission period.

I don't fax them back either if fax backs are required.

While we're on that subject, I did a signing last night. When I gave the borrowers their copy, they said that the last notary had told them she would send them a copy (?????) and they never got a copy of the docs. Unbelievable what goes on in this industry.

I agree with Paul. It's not my place to decide whether the BO should have a copy of the lender's instructions . . all 23-28 pages of them. I print everything for them and just point out the lender's instructions to the BO, tell them they can look over their copy at their convenience, particularly if they have insomnia anytime in the next 3 days, and move on. The only copies I do not print for and leave with the BO are the single-page directions solely for the notary.

Agree with PAW....and...

....once, a borrower made mistakes on several documents and I grabbed his copy package to replace them. Afterwards, he told me he did it DELIBERATELY and my reaction (calm) and ability of being able to replace those random docs assured him that his packet was a full copy of the package he was signing.

Hmmmm....you never know...Don't decide for the borrower what they are entitled to. Whatever the TC emails you, give the borrower an exact copy of everything.

I print everything too and I call the hiring entity to let them know signing is complete.

I know another NSA who picks and chooses which pages she gives the BO. This is a lawsuit waiting to happen and UPL too, I informed her of this practice and she says Oh well! Too bad its only a matter of time!

Interesting thing is, tho....

that in overnight docs, (sent either to me or the borrower) the borrower's copy practially always has far fewer pages than the signing copy. It's obvious the lender/TC do not send a complete pkg to the borrower. I've never closely examined what they leave out, but one time when the borrower messed up on the DOT sig page, I pulled their copy out of the FEx envelope, and the DOT was NOT there!
