MERS - Important Court Decision

The Kansas Supreme Court ruled that MERS was not a necessary party which had to be notified in a foreclosure. You can read the decision at: http://www.kscourts.org/Cases-and-Opinions/opinions/supct/2009/20090828/98489.htm.

The court observed the MERS had taken a position in a Nebraska case that it had no interest in a mortgage, and that it only provided a service.

You can google "Kesler" and "Landmark National Bank" to find the Kansas Supreme Court decision and related articles.
