There oughtta be a (CA) law! ....
(this applies to CA notaries only, cos I don't know about other states...) but there should be law that says a public official cannot be required to disclose their personal information in the commission of their official duties. Such as provide a copy of their DL/Passport and birth certificate, etc. That way, Prospect Mortgage couldn't nose into our personal information, which they have no right to do. But few TCs/SSs will stand up to them. I have called the NNA about this, which said they were beseiged by calls from notaries complaining about this intrusion. I also called the SOS, which, of course, couldn't care less, cos they generally don't give a hoot about protecting or sticking up for notaries, but the nice woman I spoke to said she thought Prospect was way out of line (which they are), adding that anybody can call the SOS office to verify a notary's commission and the only info they provide is confirmation of the commission and the address of the notary. They are prohibited from giving out personal info, which is why Prospect does this end run to get it. When we provide all this personal information, we have no guarantee of privacy. The lender and/or TC can do anything they want with it - at least the borrower gets a copy of a privacy policy! If I had the slightest confidence that a lender and/or TC would be ethical and responsible with my private info, it wouldn't be so bad.... but I've been in this business long enough to know that's not going to happen. On this same note, I had a SS tell me to provide my SSA, and when I gave them my EIN, they said no, they meant my SSA, I said sorry, no way; they said sorry, too. Fine with me. Just what I need: my SSA floating around some SS office. Yikes!

Re: There oughtta be a (CA) law! | Since day one...
I have maintained that one of the plans of SSs, and lenders, to collect so much information on a notary was so that they could check their credit and market to them with loan products.
There is NO WAY that at least 50% of the sleeze we have worked for in the heyday of signings didn't sell our info for mailing and credit checking. Unfortunately, in the last five/six years I have not applied for credit or sought to do anything but free myself of all debt...I'll bet I would see some dings.

Unless I was doing business with Prospect Mortgage, or hired as their employee, they would not get my private info. If having my personal info is a condition of being a SA for them, I guess I won't ever work with them.
