Serious / funny story.

Got a call from a SS that I do a lot of work in my area telling me I missed a couple of signatures on some Docs. They sent them to me to sign and send back.

Oh shucks, I made a mistake?

I get the Docs and it is NOT my handwriting but someone else. I tell them, sorry not me. They can’t find in their system who did it.

On a follow up call I find out the borrower had a “friend” who was a notary and offered to do it free for them. The friend blew it.

Just another reason to get proof of an error someone says you made.

I had an example of that today, too. I was asked by a LO to come to a signing close to me just to do the notarizations. I hesitated because it was EOM and I knew I would be busy. But this sounded easy and he agreed to a higher fee than he first asked for. I get to the signing and he says, BTW, that the docs need to be signed with the previous day's date. I explained that no-can-do, and we move on. He's got a neat pile of docs in front of him, doing a "point-and-sign", presenting one document at a time, then using both hands to turn each page, one at a time, back onto the pile in front of him. (Don't know why I mentioned that last part, but it just struck me as different. Wink) He had turned the ones needing notarizing sideways, and whenever he got to those, he then gave them to me to do the notarization.

Today he emailed me saying that he "I need to meet with you to have one document notarized for the XXXXX File. It was missed during the signing process." I replied with what my fee would be to go back to the borrowers and asked him to contact me so we could coordinate a time. He called me back and said that we didn't need to meet with the borrowers again, just complete the notarization. After several questions, it seemed like it was my mistake, that I just didn't stamp it. Whoa... different story. I said if I missed a stamp, I would take care of it at my expense, but I would need to see a copy of it first. (I was on my way to a signing and said we could discuss solutions once I'd seen the doc.)

Long story short, when he finally sent it to me, the notary section was untouched. (And it wasn't even the right verbiage.) It was clear to me that he had just given it to them to sign, but hadn't presented it to me to notarize. Since I wasn't the one to find the pages needing to be notarized, not my error. Naturally, he tried to blame it on me - in every way he could think of - but I'm not buying it. (I did check my journal and there was no entry for that document for either borrower.) Fortunately, I had escrow's phone number and will be invoicing them directly.

I'm not sure what this guy's game was. I guess he just figured he would try to save a few bucks, but the figure we agreed upon was pretty close to a full signing fee. By the time he adds in what it cost him to pay for gas to drive to the borrower (at least 30 mi each way), he would have been much better off if he had turned it all over to me to handle.

Costly, short-sighted mistake -- but not mine!
