I have just been caught in the &%#@)&%# association vise
My best client, a Texas company, has been bought out. The purchaser supposedly insists that all its closers have a background check by the &%#@)&%# association. I have heretofore resolutely refused to yield to any request for a check by the &%#@)&%#NA.
At this point, I have sent my present background check by another agency to my client and asked them to submit it to the new owner.
I know that others have run across the same thing. What did you do? How did it turn out? After you were through calling down divine justice on the &%#@)&%# association, did you then turn to satanic imprecations? Did either have any effect?
Should I actually turn in that application as a Wal-Mart greeter? If I'm going to take a 9-to-5, that would probably have to be it; I've searched every place I can think of, and have found not a single opening for a Resident Curmudgeon.

I hear that! In the last 3 years, there have been 2 major class action lawsuits against the &%#@)&%#. I'd like to hear more about those FBI investigations into this that I have read about in earlier posts.

I will never trade at the aforementioned place again - under any circumstances - especially if "required." *Especially* if it's about ~my~ creds. Which, the BGC is.

I'm no lawyer, but this just smacks of collusion to me.
To say that you have to use theirs and no other comparable or even better background check will do, well, that just smells of a backroom kickback deal to me. Just my opinion, I have no facts to substantiate, I have no knowledge of said deal, etc., etc., etc....

The thing about a Monopoly is it's Anti-Capitalism. We customers lose the choices in Commerce, in our Work-a-day lives, every day, everywhere, across America and her Island Shores.
No "national association" is going to put other and competing Businesses out of work, thank you very much.

True Susan!
The problem I have with your statement is we often pick only one battle to fight on this front, and do not live what we preach!! If you truly believe in Capitalism, do you:
1. Not shop at Wal-Mart and buy only at the local shops where you know things are more expensive.
2. Not pay for advertising at a place where they actually cause a monopoly to happen, even though you may not get as many calls as you once did.
3. Do you stop using your cell phones, banks, etc, when their companies put others out of business?
4. Do you deal with a company that may not be based in the USA?
The point I am making is, we all have our reasons, but most often, true beliefs are not one of them. It is usually something they have done or not done to make you feel that way towards them!

No. Not to my knowledge - all US based companies, as far as I know...assuming you mean those who actually hire me. Can't speak for Lenders.
So, what's your point? I shop locally more often than not. I don't support Big Banks - I support local economics with local Credit Unions. I try to deal with US companies when I have a choice.

My statement was a personal observation and not an attack on you personally, sorry if you took it that way.
But since you mentioned it…If you are not consistently living what you preach, don’t preach it!
Although I am not normally a politically motivated person, some of this crap has gotten to me…. The rest of my thoughts should be in JP, should I choose to post there sometime!

&%#@)&%# association uses Lexisnexis for their background screening. Maybe you could get one from them directly and avoid dealing with them. Just a thought.

As I understand it , if a company determines that if
you want to do signings for them, then you will show up for the signings wearing a pink tutu, then you can either go to the ballet supply store or work for someone who is not into pink tutus. This, of course does not apply if their dictates include a prohibited matter such as involving race, religion, national origin , etc. I have never been a beiever in the practice of sticking to your guns, even if it involves shooting yourself in the foot. Good luck in resoloving your quandry. Actually, I think that you would look quite dashing in a pink tutu.

As an Independant Contractor - not an employee - they hire me to get a job accomplished. How I go about accomplishing that job is up to me. If they try to dictate how I am going to do it, they will have to hire me as an employee.
If they chose to hire me because I have a BGC from (*&^*& Assn, they can do that. If they chose to not hire my because my BGC is from Lexisnexis, NotRot or Bozo the Clown, that is their perogative. Do you tell your CPA how to dress while he/she is doing your taxes? Do you tell them what associations they HAVE to belong to in order to do your taxes? No, you can choose to do business with a CPA because they are a member of a certain organization, or you can choose to not do business with them because they do not belong to that certain organization. BUT... how far do you think you are going to get if you go in and tell them that they HAVE to join that organization before you will give them your business? Not very far in my opinion.

Do they still require membership and their certification class to get the BGC? That is what I object to. Coerced membership in an organization. They nailed those types of requirements to get into pools for insruance, I remeber haveing to belong to some tax organization inorder to get private health insurance. Also at one time I was in with dairymen.

One of the major tc's I work with starting sending emails
with XYZ stuff. I emailed them & told them I would not participate. They assured me it was not a requirement & would not affect my relationship with them if I CHOSE NOT to participate. This outfit is run by lawyers, so I know they couldn't force the issue. :-)
