Signix vs. NNA Settlement
Looks like all I have to do is write in and stake my claim for $302, reimbursement for the bg chk they did in 2007, plus $250, well, hell, better than a poke in the eye.
I wonder how many people were named in this settlement as recipients entitled to reimbursement.
Obviously not that many people on this board. Last year I made the conscious decision to cut away a lot of my affiliations due to expenses, changing market and lower signing fees being offered.
A lot of companies I worked for two years ago don't even exist, and I found another market to supplant that lost revenue. I think NNA has diminished in size tremendously. Those not in the signing biz don't want the liability or responsibility that comes with the territory.

"write in and stake my claim for $302, reimbursement for the bg chk they did in 2007, plus $250, "
Why $552? My understanding is the settlement is $52 per person/claimant - if this is the same one that was posted about previously. How did the BGC cost you $552? or $302 for that matter.

I will confirm in a while. Called counsel definitely $52 reimb, then $250 for certain sub agents, $302 total.

Sub-Class Members...if you had adverse action taken against
you...
"Who is a Sub-Class Member? For the period from October 6, 2006 to April 22, 2009, all Class Members against whom Defendants allegedly took adverse action without (i) providing these consumers with a copy of their report and a description in writing of their FCRA rights and (ii) notifying these consumers that the consumer reporting agency that prepared the reports did not make the decision to take the adverse action and was unable to provide the consumers with the specific reasons why the adverse action was taken are Sub-Class Members. And you CAN opt for a cash payment rather than their offer of a free year's membership

The class action is for those who were not aware that a credit report was part of the Background check. The sub-class is for those who never received a copy of the "Screening Solutions Summary Report" is the way I understood the counsel.
The report summary list: InstaCheck – Identity Verification Multi-State Court Search (National Criminal) Blocked Persons List (OFAC) Criminal Records Search Driving Record
There is no mention of a credit report on the summary. It also does not pick up states off of the main land.

If you look in the stipulation PDF file, there are pages and pages of names listed under the class they belong to. The majority fall under the $52 provision. The ones that get more are those, as I read it, that were actually denied the CBG status based on the background check (adverse action). When that happens, they are required to notify you of certain things, and apparently they failed to do that.
I don't think they actually pulled entire credit files, just some parts of it in order to verify identity and address information.

I still think this is odd. There was another class action suit brought again Lexis-Nexis about 2 years ago. Now Signix. These are both companies affiliated with NNA bgc's. I'm still smelling a rat in this mix.

Thanks for the heads up--I was named in this and never knew it. You rock! I think I only qualify for the $52, but yes, had no idea they were going to pull my credit info. :-/

How did everyone select the $52 back option? I called the 757-873-1010 number (attorney handling the case) and they are emailing me a form to complete. Just wondered if there was another way to select the cash back option that I missed?

Here's how to ask for the cash:
Download (and I suggest reading) the following PDF:
http://www.nationalnotary.org/stipulation.pdf
Do a search for your name to see which class, if any, you might be in.
Go to the end of the file and you'll see the form to fill out. It's page 420 of the PDF, "Election of Cash Payment."
Mail a copy to BOTH attorneys:
Class Counsel Leonard A. Bennett Consumer Litigation Associates, PC, Suite 100 12515 Warwick Blvd. Newport News, VA 23606
Art Silbergeld, Esq. BINGHAM MCCUTCHEN LLP 1620 26th Street, Fourth Floor, North Tower Santa Monica, California 90404
However, on page 19 of the stipulation, you'll note that if more than 7.5% of the class members opt for the cash, the NNA may not settle. So, remember this is only a proposed settlement.
Honestly, I think a lot of us are hoping everyone asks for cash. It will not be a pretty outcome for the NNA if that happens. 7.5%? That's not very much.

Awwww.. wouldn't that be too bad if it hurt NNA's cash flow.....

That's just it - they won't allow that to happen
if over 7.5% of those eligible file for cash payments they won't settle.

The address I received when the form was emailed to me is:
Christopher Colt North The Consumer & Employee Rights Law Firm, P.C. 751-A Thimble Shoals Boulevard Newport News, VA 23606
(757) 873-1010
I was told to mail it back there....hmmmmm seems confusing. I assume they will get all the forms to the right place.
