Here it is EOM--3 postponements because of changes--new regs much be in place & slowing things down.
Anyone else running into this?

talked with one of my regular title comps today. She said Lenders are all in a tizzy with the new regs. Had one cancel for tonight, they want to get er done tomorrow, backdated of course. Sorry, no can do.

Same here everything is in quite the mess. And NO backdating in Colorado either! No way.

I wouldn't backdate a doc if you paid me $100,000.00 to do it. Now if they were to transfer $5,000,000.00 into an offshore account, and I had time to totally evaluate the risk of getting caught in advance....LOL J/K

I have had calls to backdate docs before. Haven't had one in quite some time. It's just not an option for me on any level. Never got another call on those same closings again...HMMMMMMM.

called to update with borrower. He is fully aware of the backdating issue for tomorrow. Told him I cant backdate as a notary, we can go to jail for things like that. It didnt seem to bother him. I told him they(meaning the comp who hired me) will have to find someone else unless they want to put the correct date on the docs. I dont think he really cared that it was illegal. My thinking is he doesnt understand the ramifications if they backdate cause they are being told it has to be done this way. Its so sad.

Don't really care what date the docs they sign have on them. All I worry about is the RTC, ID docs I fill out, and when I fill in a date on the docs I notarize. Those are the ones the date matters to me.

Same here, except this was an everything backdated situation, not just the date on the docs. Everything to be backdated including all my notarizations and the RTC to read for todays date. The borrower told me the dates would all have to be todays date Frown . I already knew about this before I called them as I had spoken with the title comp who isnt very happy about this either.

there might be a possibility of me still doing this closing. If by some chance they cant find anyone to backdate, they will have to change the dates. I already told them if it became a legal situation, I would be more than happy to accomodate the closing. Keeping my fingers crossed Smile

Hope it works out for you, Lisa! Personally, I BLACKLIST any company that ever asks me to backdate docs, and will never work for them. They've already asked me to do something they KNOW IS ILLEGAL, so why would I expect someone that tries to solicit me to perform a KNOWN illegal act to pay me. Think about it.

This isnt just some company, they are one of my regular title comps. Im not holding anything against them, they have a right to run their comp as they have to. I do know she isnt very happy at all about this, I could here it in her voice. I have no worries with them as far as payment goes. Im actually hoping that they will figure out a better way and its all going to work out ok for everyone involved Smile

You DON'T backdate docs, Lisa, even if it's your ONLY CLIENT!

ON THIS DAY, (TODAY'S DATE) PERSONALLY APPEARED LAVERNE AND SHIRLEY!

If that date is filled in is YESTERDAY'S date, then you have committed a crime, period, and that is ONE thing that is consistent throughout the U.S. for notaries of all states, and EVERY LENDER, TC and SS knows that. I don't do business with any company that has requested that I perform a criminal act for them. "Hey, notary...will you shoot my mama for $125? Well, if not, will you backdate these docs for me for $125?" Both would be crimes, if you agreed to them, and I don't deal with any company that asks me to commit a crime.

I would contact the company and tell them that Ms/Mr X asked me to commit a felony. If the company acted appropriately, and fired that individual, I would continue to work for them. If not, they're off my list of companies to work for.

Sure they can ask you to backdate docs ....

after all, they aren't the ones that would be facing jail time. That spot would be reserved for just YOU and the borrower's. But hey, they will keep in good with the lender and title.

I'm with John, don't do it under ANY circumstances. If it were me and that was my largest client, I would either find new clients to fill the void or start looking for other work that wouldn't potentially land me in jail.

Besides, I'm too pretty to go to jail! LOL

not thinking I would do this. I dont backdate, never have, never will. Ive had some pretty good comps ask me to do it and Ive declined every single time. You know, some times even the good guys get sucked up into the quagmire and find themselves doing things they might not normally do. After all, they are human and they have a business to run and sometimes against their very morals they get pushed to the other side. Call it human nature at its best. I dont hold this against them. The important part for me is they know once they approach me on the subject to never ask me again, respect me for it and continue to call me knowing I am the best closer they can get for this area Smile. They know my stance on the subject once it has been discussed, believe me.
