March 2010. Someone else I believe said Feb. Just because they are current with you does not make them current accross the board. They are playing on your sympathy(ies). Do not fall for this.

Good for you. They are too much trouble for anyone. They are involved with State of MA in court case - Msg #343931 and are losing. Those laywers are not cheap, even if they are house lawyers. So they will contract out work in the hopes they can stay afloat and live off you and I and all the other notaries who will fall for their lies and misrepresentations. They will not answer your questions either through calls or emails and everyone will just be behind the eight ball again.

Your times should be more carefree than what they will offer you.

Technically they're not losing

They won in federal court, but that was reversed and remanded to the state court on appeal. That doesn't mean they're losing, only that the matter is still undecided. Since it was remanded to the state court, I'm guessing that at least part of the appeal had to do with the argument that the case should never have been tried in federal court to begin with.

I'm not defending NREIS or what they're doing - just pointing out that neither side is winning or losing at this point.

I have a question. Don't know exactually what the law suit incurrs, but it sounds to me like
ANY state could bring suit against any of the Title companies that we work for. If NREIS uses Notaries instead of Attorneys for closings, so does all the others. Arent' they claiming NREIS is practicing law by signing loan docs in another state? But since they don't use attorneys, they won the first suit. Now that has been appealed....right?

It was not the state that brought suit against NREIS - it was the Real Estate Bar Association (REBA) of MA, because MA is an attorney-only state. Since NREIS was hiring notaries to perform signings in MA, REBA is alleging UPL.

NREIS was able to get the case transferred from state court to federal court, and the federal court found for NREIS. That decision was reversed on appeal (possibly due to wrong jurisdiction, among other things) and remanded to the MA state court to be re-tried. I think that puts them back at square one, and they start all over again.

This probably would not happen in a state that doesn't have attorney-only rules (most don't). I say "probably" because there's always the chance that some notary will start giving legal advise at a signing, crossing the line into the land of UPL...

I received 3 check from NREIS ang they still owe me for May and all of June They will be current when my balance with them is $0.00.

They still owe me 5 months back - present. We are taking them to small claims.
Hopfully that will show them how serious I am about getting my pay.

Yes, i will be calling my Prepaid legal attorney also, maybe the letter I'll have them write will scare them into payment. If not, I'll pursue other matters as well.
