Need Help.....bad notary service
I had a signing done in Maryland and provided the notary with a prepaid USPS label so she could get the docs back to me. She first sat on the docs for several days and emailed me and stated that she was "out of town" so she could send the docs. Odd, right??? So then I emailed her several times, call her as well and received no answer what so ever. I finally got her on the phone and she said that she put the docs in a drop box but the USPS site shows no tracking for the package. I think she's lying to me but I don't know what to do now. The client gave her original documents so now those are lost at this point. I'll take any suggestions at this point, I completely called her out and all she said was, "well send out someone else". Help please......

I'm not a SS, so I wouldn't know the standard procedure in this case, but ... thinking outside the box, and depending how desperate you are, you could call a reputable notary in MD (Ilene Sliedel comes to mind) and ask her to intervene. Maybe she lives close (?) to your bonehead notary or knows somebody who does and could intervene. Just show up at the notary's house and say they are there to pick up docs! But who knows what happened to the docs. Maybe the notary lost them! Maybe her dog ate them. However, it looks to me you should just cut your losses and have the whole thing signed again. What does your client say?

Not that I'm defending her or anything, but it is curious as why she just screwed herself out of pay....
But what is that old saying, oh yeah, "you get what you paid for" comes to mind. But, you could prove me wrong...how much did you pay her and what SS are you with?
Have you hired her before? What type of loan was it? Questions questions...

Ooops - hit wrong key...
I wasn't aware that USPS provided tracking information or had a website for follow-up.
No excuse for sitting on docs for a few days - out-of-town or otherwise. In the past when I've been "out-of-town", I was able to find a local FedEx office (in my case) to drop the documents and get them back in time.

Yes, USPS, does have tracking for packages, just pay a few
bucks more for it...I use when I sell my books online...

Sounds like you got a notary that either lost the documents somehow or just doesn't care. Your best bet at this point is to get another notary asap and hope that the original documents the client gave her can be replaced. I and all of the caring professionals on this forum apologize for this notarys extremely bad behavior. Perhaps someone from Maryland can give you advise as to whether or not other actions can be taken.

Call my cynical....and I do feel for your situation but, Mr. O'Keefe, I'd like to know who you are and what company you represent before offering advice and throwing the notary under the bus on an anonymous poster's word.

He's probably a troll. Trolls post controversial, one sided scenarios to get heated dialogue going with no intention of responding to even one inquiry. The troll sits back and watches others speculate, guess and possibly argue amongst themselves over a made up, far fetched story.

One of the dangers of this business! Not only are there untrustworthy SS’s and Title Companies out there but also incompetent, unprofessional, and untrustworthy Notaries. In Maryland, a NSA should be also a licensed title producer, and I believe bonded. If you (or the borrower) suffer any loses you may have recourse. You can look them up/file a complaint with the Secretary of State, or MD insurance commission. Looks to me like you will have to redo the docs, and have them resigned. If in the Baltimore area I’d call Barbara Taylor ([e-mail address]), if she can’t do it she should be able to recommend someone competent. Sorry for your trouble.

One of my hard and fast rules about sending loan docs? Always get a receipt! I never, ever use drop boxes. I will always go to the counter and get a receipt ... and you can do that with UPS, FedEx, USPS and all of the other sipping services. It shows proper "chain of custody" - and I'm surprised not more NSAs do that.
I always want written proof that I've handed a package off. Always.
Even when I hand deliver packages in person to Totle/Escrow, I have a form that I make them sign.
As for what to do? Hire a reputable notary and get it done. And why have the borrower send original docs? Oh well... I'm not touching that one. I never accept originals of anything -- only copies. I tell them that if Escrow/Title wants originals, they need to make arrangements to ship them directly. The only originals I deal with are the loan docs themselves and (if absolutely necessary) checks. I'd prefer not to handle checks, either.... but it does happen sometimes.

USPS?
If the docs were sent USPS Priority Mail, the updates are very slow to show up. I've had packages delivered before the tracking information showed up, especially if you provide a 'return' label. That is, the package isn't originating from the same zip code as the company paying the postage. I have that problem all the time with USPS PM from Washington DC back to me when I provide a return shipping label.

Why are the docs coming back to *you* instead of being sent directly to the TC? Did you offer a lowball fee such as $XX ? When you pay a lowball fee, you get lowball quality work. When you pay a professional fee of $XXX to an experienced Notary then you get a stellar signing completed. A Notary worth his/her salt would not just hold on to docs after a completed signing. Those docs would be shipped and on their way to the TC.

Choose only 5 star Notaries for your signings and pay them a professional fee, no less than $XXX so the job is completed correctly and promptly the first time.

Even loan mods are shipped back by ups or fedex. Or is this a different type of loan mod? And, why were these originals? Sounds odd.

My guess is it's a respa signing or loan mod application signing. You normally get copies of their last mortgage stmt, bank stmts, tax bill, credit card bills (if they are paying them off in the loan) and other things along that line. Most people just give you the originals instead of making copies of them. Could even be a reverse loan app.
Regardless of what it is/was there was no point in posting on here. If the docs are "gone" there is nothing to do, but reschedule and have the borrowers resign. Period!

There's so much speculation/investigation here. IMO,
regardless of the transaction, if the notary accepted & completed the assignment they needed to deliver as promised. If it's a loan mod app & they didn't want to be party to that, then there would have been a way to handle it other than just holding the docs hostage. Just my .02
