No-way sign-up package

I received a multipage sign-up pkg from Finiti Title LLC, recently discussed here. "Exhibit A" listed 27 services notaries/attorneys must agree to, including this one (which was in bold face type):
" You agree to review the Lender's closing package to ensure that the documents included in the package exactly match those listed on the Lender's checklist. If there are discrepancies, you agree to contact the Lender for problem resolution. In addition, you agree to initial the Lender's checklist to acknowledge the successful review of the package, and to fax the acknowledged checklist to Finiti immediately following such review."

In other words, do their job for them. Who has time for this?

Another required service said: "You agree to accept loan documents via electronic mail and agree that you will print two (2) copies of the loan documents, have the borrower execute both copies and courier one original copy to Finiti."

I've never heard of a borrower being required to sign both copies.

And several times in this sign-up package it said if the vendor or anyone in the vendor's immediate family had any affililiation with Citi or First American Title or any of their subsidiaries or affiliated companies, you couldn't work for Finiti ...?

I just did one for Finiti and we had to execute 2 mortgages. Not 2 packages, so that is strange. And it was a Citi also.

And as for this Lenders Checklist, I remember this from the closings I used to do for a certain company and she had wanted me to initial that checklist but I told her it really wasnt for me to be responsible for, it would be the responsibility of the settlement agent. She agreed.

The Citi I just did was a very sweet small package by the way. Only about 50 pages or so for the lender portion. A nice change of pace.

Although I'm in disagreement generally with these sign up agreements I think I might go along with it if it was as Lisa mentioned, 50 pages. But the real concern I have is how much is it paying? I think Doug has spoiled us Goldgirl, he's made it too easy. hehe

No kidding, James. All he asks us is not to backdate!

But I'm still perplexed by Finiti saying the borrower has to sign two complete copies. But it's probably like Shoshana and Lisa said - they really meant only the note. Back in the old days when NASCO was around, I did hundreds of Citi HELOCs, and there were three deeds in each pkg.
As for Finiti requiring notaries to review the lender's package and fax back that everything's in there, I could live with 50 pages. I was envisioning 198 pages or so that seem to be the norm these days!

I had fairly extensive discussions with them about their contract. The Finiti rep told me the part about the bwr executing two copies was a mistake. But ultimately we were unable to come to an agreement on some other provisions, so I only work with them through signing services.

I have received a sign up pkg from finiti months ago. That was followed by several phone calls from them asking me to please sign asap as they had a lot of business to give me. After reading it through I questioned them on the same issues talked about by the OP.

I was told oh that's a mistake. That was several months ago and this mistake is still in their sign up pkg?

When I questioned the other items I was not comfortable with I was told I could cross out anything I didn't agree with.

I found this to be kind of fishy because if everyone is having the same issues with their sign up pkg. why don't they just change it. Also, some sign up pkgs. have a sentence stating anything that has been changed, that change will not be considered or something like that. I don't remember if finiti sign up pkg had that stipulation or not.

Anyway, that's my experience with finitis sign up pkg.
