Notary

Fs 117.107[11] states that i can't sign a document for Father, Mother, Sister, Brother,Daughter or Son, But my Sister-N-Law needs a power of attorney done Am i ok with notarizing this document?

I would advise against notarizing for any family member even if they aren't covered under the statutes - especially a POA. Could come back to bite you in the butt.

Here's how I look at it

Will it make any difference to you whether or not the person signs it? If so, then you shouldn't notarize.

For example, my stepmother wanted to sign a document designating my grandmother as authorized to consent to medical treatment for my young sister. Even though I am not prohibited from notarizing my step-mother's signature, in this case I declined to notarize, because I would get a benefit from notarizing it - the peace of mind that my sister would receive appropriate medical attention in my step-mother's absence.

But, it's a case by case basis. I have notarized my step-mother's signature on other miscellaneous documents, such as an application to join the DAR. When doing so I always hand-wrote a statement that "affiant is not related to me within the prohibited degree set forth in F.S. 117.107(11)" or something to that effect.

Do what you feel comfortable with, keeping in mind that you can not notarize if you have a beneficial interest in the document.

In my opinion, even the slightest appearance of possible conflict should be avoided. Even if you're right in the end, someone could still try to drag you through a fight, conflict, lawsuit, whatever. Set them up with another colleague in the area.

the state has you living. I would guess you need to also update your address with the state as well.

lists as being in FL - but does not show in NR's database under find a notary at that zip code. The state site says Beverly Hills, FL, so, either he has moved, or posted as a guest, but a guest still has to have an account and will be listed by zip code.

Samuel, I used to be a proponent of

not being so concerned about notarizing for family members if the document did not include anything to do with the notary.

However, I have reversed my thoughts on that.

Don't get yourself into anything like that. It's just not worth it.

...depends on the POA, at least that's the way I look at it.

If its for your sister-n-law, and it is NOT forbidden by your state laws, then why not?

Go for it.
