What would you do with this certificate...

And this is mostly for Florida notaries:

**********************************************
STATE OF FLORIDA
COUNTY OF _______________
BEFORE ME, personally appeared ______________, to me well known and known to me to be the person described in and who executed the foregoing instrument, who after being first duly sworn, acknowledged to and before me that he executed said instrument for the purposes therein expressed.
SWORN to and subscribed before me on this ______ day of _________________, 19__, in the aforesaid County and State.

NOTARY PUBLIC

My Commission Expires:

(SEAL)

**********************************************
How do you have a client acknowledge after being duly sworn? Personally I would replace the certificate with two separates - a jurat and an acknowledgment - but curious to see how others would handle it.

I know what I would do.
But, you need to make your own decisions knowing that legally we cannot decide what certificate to put on a document.

Well I was asking "What would you do?". I already said what I would do, but wanted to know how others would handle it.

I would handle it by following the law.

Well then please tell me, Sylvia, where in the Florida Statutes it specifically addresses the certificate posted above.

Reply by Sylvia_FL on 3/11/10 3:39pm
Msg #326638

Obviously that particular certificate is not addressed as it is an illegal certificate (at least here in Florida).

Ask the signer which one they want or contact the

document preparer/originator and have them tell me which to use.

Re: Are you taking a test?

Nah - he just doesn't like that the majority of the posts are signing agent related, and he likes to throw out "general" notary posts. Not too long ago his recent posts would have been deleted as "excessive noise".

I think it will be quiet for the rest of the evening ... he must be trolling from his regular deskjob which shows how busy he must be ... unless he reconnects from home.

Only because no one is using the "report" button.
