Another Title/Lender issue
Wife is taking title as married S&S. Husband is to sign the disclaimer deed. Instructions emailed to me said both borrowers to sign all docs. No sig line for husband on any doc except for the disclaimer deed. I am waiting to hear back. We are expected to get it right the first time. Why can't they?

Why can't they? LOL!! (I'm assuming that is a rhetorical question.) IMO, if one spouse is waiving ownership rights by signing the Disclaimer Deed, that spouse would not sign any other document. Sounds like the left hand doesn't know what the right hand is doing at the title company.

should be. " Is hubby a borrower?" If he is then he should sign all apprropriate dox, if not, then the disclaimer deed would seem to be sufficient. Most loan doc forms that I have seen have the word "borrower" on the signature line or in the body of many dox. These dox are expected to be signed , as required, by a NBS. Just to muddy the water a bit more.

Bob, as I stated before, the only doc hubby is on is the disclaimer deed.

I think we all know the answer to that. He is not on title, he should not sign any documents. The Quitclaim Deed or Disclaimer Deed clears that matter up completely.
In the old days we were trained for a minimum of 3 years just to become escrow officers. Some title companies need to up their education for their title and escrow officers! Anyone want to help me develop another course but this one just for escrow or title?

OOPs Shoshana,
My answer was in no way a reflection on you. You are right to say you always double check and so do I. It is just frustrating when we have to deal with people who should know the answers and don't. I did not mean that you should not check when given conflicting instructions. My frustration, as I mentioned before, is with the TC and Escrow companies who put people in the positions of title or escrow officers who are not properly trained.
So, by the way, what was the outcome?
