Expired notary commission

My friend's notary commission has expired a year ago and has not renewed. She hasn't submitted her Journal to the county office yet. In CA, you have to submit the journal within 90 days after your commission expires. How much of a mess is she in? Can she just turn it in now? Or will it cause more trouble?

Nope, it's 30 days not 90.

She should turn it in ASAP.

Per the handbook:

"Within 30 days from the date the notary public commission is no longer valid, the notary
public must deliver all notarial journals, records and papers to the county clerk’s office where
the oath is on file. If the notary public willfully fails or refuses to do so, the notary public is
guilty of a misdemeanor, and shall be personally liable for damages to any person injured by
that action or inaction. (Government Code section 8209) Any notarial journals, records and
papers delivered to the Secretary of State will be returned to the sender."

Oops, my bad. Thanks for the info. My commission is about to expire in Jan '11 too.

If you plan to renew START NOW!

Seriously, if you want to renew, get your coursework and exam done now to be sure your renewal is processed.

What you want is for everything to be done and waiting so that 30 days before expiration, the SOS can pull up your file and send it out. Better to get it done and wait than risk your commission expiring on you -- which it will do if you wait much longer.

You can now do your renewal online for half the cost and time of going to an on-site class.

And if you're a Premier Member here, you can get a very good class for free. Can't beat that with a stick! (BTW, I haven't checked lately to see if that is still the case. I last did mine in June of '08.)
