Can a spouse be a witness on a Open End Mortgage Deed. They are not on Title or on the loan.

Yes, technically a spouse can witness as long as they are not a party to the transaction but I find that I feel better if I ask the borrower to have someone else just so there is no issue. I believe it is just "cleaner" that way.
