Disclosure: Please be advised that calling the borrower, lender, title or escrow company in an attempt to collect a debt incurred through our service is illegal and could result in potential litigation.

I have seen the same type of disclosure popping up lately on most of the ss confirmations. Personally I dont think there is anything wrong with it because technically none of those people hired us so why should we be calling them anyway.... If I have a problem with payment I just email them that I will small claims them and then follow up with actually doing it.

Hmmm...You're in California. You file many small claims actions in Vermont? Virginia? New York? Florida?
In fact...have you ever filed a small claims court action out of state?

The potential litigation part might be true but that doesn't mean they will be successful. I think you would have to know what you did illegal to bring that on? MY .02

Sounds like they're trying to hide behind the Fair Debt Collection Practices law, which makes it illegal for a debt collector to contact a third party in an effort to collect a debt. I think that only applies to consumers, not B2B, so whether or not doing this is "illegal" is questionable.
Regardless, any company that feels the need to add that disclaimer to their email is a company that should be avoided - they're telegraphing their intention to not pay for services rendered...

You should e-mail back:
"Your disclosure is duly noted, and here's my disclosure to you:
Disclosure: Please be advised that nonpayment of a debt incurred through your (signing) service is illegal and will result in litigation."
That should start everything off on the right foot!

Good one. Actually the "disclosure" was added to their correspondence after I inquired about payment. It was not on the original closing order or any other prior emails. It's so incredibly pathetic!!!!
