Georgia Closing Agents

I closed a loan for a Georgia property are two witnesses required on the Security Deed? I may need to go back.

2 witnesses on both deeds of conveyance and security instruments, one may be the notary (GA Code - Title 44 ยง 44-14-33).

That question was my last correspondance with GA Attorney (Toby) shortly before he died.

"One of the recording requirements for a security deed in Georgia is that there be 2 witnesses, one of whom is a notary. So that's why it has to be signed by someone else - so that it can be recorded.

* should have sent you an instruction page with GIANT BOLD letters explaining that requirement, but it sounds like they dropped the ball. The non-notary witness, sometimes called the unofficial witness, is supposed to sign indicating that either (1) he saw the borrower sign the document or (2) that the borrower acknowledged to him that the signature was in fact his.

No language has to be added - just a signature and a notation that he is a witness is enough.

Lots of title companies probably would have just had someone sign as unofficial witness, although that is not really a proper thing to do as they did not witness the signing nor did they have the opportunity to have the borrower acknowledge his signature in their presence. So actually ServiceLink is is right - anyone (anyone 18 or older, that is) can do it, but to do it they must at some point be in the presence of the borrower."

Why is the sky blue? I guess they dropped the ball I don't send docs back incorrect so went back to borrowers 40 min drive and took care of Security Deed. I don't do stuff half way. This loan was a problem from the get go. The title company sent the loan package to the attorney in Georgia and it was a 9am closing so it screwed my day up. Didn't get home til 11pm.
