Actually sign contracts with ss or settlement co's? I had one presented to me last week where I was agreeing to a total fee of $85. + a travel fee if deemed necessary by them, a reduction in fee for various mistakes, agree not to work for any bank, mortgage co., lender, title co.. or any of the other "clients" that they may represent and last but not least, if the loan does not fund, I agree to a whopping total of $25. I can't in good faith sign such a contract and let them know that in a most respectful way. Well I was told they would find someone else and I agreed that they should. Today, the borrower calls indicating she was concerned she hadn't heard from me and was wondering why not.....totally caught off guard, I told her that in fact I wasn''t the notary scheduled and was terribly confused and would help her find out what was going on. She said her LO had given her my name and cell..............then it hit me, this was the signing for the settlement co. that presented the contract....

Sounds like the ISGN contract. I do not sign contracts that have any wording that coulb be interpreted as a non-complete clause. I did sign this contract. As to thier fees, I can give them my fee for the signing they are calling me about or find someone else. I do not like the "reduction of fees if you don't do this right", but it is a fact of life in doing this job. If the SS wants to deduct for our mistakes, then thier should be a fee for having to rearrange my time waiting for the docs so I can do the signing.

I would never agree to not be paid. Hopefully you'll have the opportunity to make the correction at your own expense of course. Reduction in fees, never.
I do not sign those type agreements period!

I've signed very few contracts. Normally I'll sign the "professional code of conduct" parts, and strikethrough all of the rest with a note as to my disagreement. I'll list my fees instead, I'll make notes that I do not actively solicit the customers of my customer, but I do actively solicit new customers, which may include theirs. Basically an "I won't be tacky, but I work for more folks than you." None of my "favorites" have ever asked for a contract of any kind.

The few I've signed, I just cross out the preprinted fee and write "to be negotiated on a per call basis".

After a couple contracts, I learned it's unnecessary to agree to your fee. You can sign contracts, but cross off the fee agreement part. They'll accept it. Fees should always be negotiable due to circumstances, i.e., weekend work with little heads up time, etc.
