A FIRST FOR ME....Borrower objects to my "notary fee" on the HUD1.....Refuses to sign. Says they don't think I should be paid THAT much for what I'm doing. I asked them if they had any idea what I should be paid and they said yes. So I told them to draw a line through the objectionable fee and write in what they thought, then initial it. Boy, I tell ya!

Can't believe you allowed them to do that. You should have explained the process. I've been sitting in my office for a closing I accepted at noon today for 5pm and damn it I'm still waiting for the package. And the title company doesn't respond to my emails so I had to call her she acted like she didn't know who I was. Putz!

I can't figure out how you're getting into all these fee issues with the borrowers, James.
I don't ever have that conversation. It would be my position, however, that if it came up I would have them call the LO for an explanation. Are you kidding me? We're at the end of the food chain so as it is.

James solution was good. BO refusing to sign because he thought notary fee was too high. BO changes the HUD and initials and thinks he has changed the fee. Signing goes on as planned (hopefully). Alternative is argue about the fee and signing doesn't happen. I would let the SS or Title co. know about the issue after the signing. JMHO

I KID YOU NOT...There went over the HUD1 with a calculator....everything figured out. I did explain the taxes being paid in advance with accounted for an addition they hadn't planned on. Then they starting complaining about the fees. FAX Doc fees, messenger fees, etc then finally me fees. I didn't say anything, notary fees $175.00...WHAT??? No this guys was a senior counsel for a very big company headquartered here, over $250,000.00 per. Well he just thought it was too much period.

People who are pi$$ed at the way there are treated by lenders have to vent to someone, why not us bottom feeders?

You'd be surprised at what I get but here, no body would want to admit it happens so mute point.

James, I'm on your side on how you handled the signing. However, I don't consider us bottom feeders. We are facilitators and without us the loan process will probably not happen.

Yep,,,I remember having to take off a day of work to re-fi my house back in the 70's and 80's. Sitting in the title companies for hours. How many families in this economy can afford that?????

That's interesting, Jim. IMHO I wouldn't change any figures

on the HUD unless instructed to do so by the tc. I keep forgetting that things are very different in CA. There is HUD is only "Estimated" until it actually funds & disburses. Figures aren't final until then. I did one for a prop in HI the other day. It was the same thing. It's just not what I'm accustomed to. Here we have a Final HUD (even though that can also be adjusted during the RTC period).

You can't just let them line through and change

numbers they don't like...any changes to the HUD, or any other document for that matter, goes through title first - but ESPECIALLY the HUD - you can't just change numbers.

If I'm reading your post correctly, you had them line through the fee on the HUD of an aborted signing..correct? Or did the signing go through when they made the changes? Personally, when he started crabbing about the numbers and the fee to the extent he did, as soon as he refused to sign I'd have picked up my toys and gone home.

This sounds like LO neglect and non-communication to the BO. Three choices IMHO in my order. Contact the LO and let them talk to BO. Line through a non-notarized HUD document and let the LO and BO work it out after a completed signing ( RTC by the way). Refuse to complete signing. This should generate some comments. LOL

signing proceeded after changes...I have received..

instructions before to allow borrower to make the changes on HUD1 BECAUSE there were making up a new one to send out.

Lender was changing some other fees, not mine. I will be paid per the agreement with SS after loan closes. There's a name for borrowers like that but no need to say it. I'm okay with it, it's called life.!
