DTF was right...Freaky Friday

No cancellation or late docs...BUT

Mr. Borrower Questions payoff on HUD - rightfully so - it's $10k less than he expected...find out we're right and they're using escrow to reduce payoff; okay...start signing..

He could care less about the note - poo poo's it away...nod,nod..okay..okay; sign sign....get to Correction Agreement and Limited Power of Attorney - weeelllllll.....not only is he reading every word of it - he's critiquing the grammar and sentence structure - to a point I finally smiled meekly and asked him if he's an English Professor!! (sheepish grin)...

We finally get by that - does he question any more docs? Mortgage, TIL, Escrow Analysis, Payment Letter, the 12 RTC's in the package? NOPE!! Guess he's worn himself out on the Ltd POA and he just signs everything, no questions, signed, sealed and off I go..

Who'da thought to present the Ltd POA first?...

Freaky friday is right..My last closing of the day tonight..I had called Bo to confirm appointment but she never responded. Anyway get there to find out she is married. Ohio is a dower state spouses must sign dower docs. (TIL, HUD, RTC, MTG and Itemizated finance docs). The husband is not there. She calls him to come, meanwhile I am on the phone with TC..its Friday night no answer..But its understandable they are tired too!

Call the LO who calls back..
She starts talking about spouse not being on the loan or on title so he does not need to sign. I asked her about the dower docs?
Then she stumbles all over herself..She is in Ohio so she should know..She says she will call TC to see if they can tell me which docs spouse needs to sign..TC calls me right away..Yes spouse are to sign the dower docs..Thank You!

I knew something was not passing the smell test and just glad that we finally got spouse to sign so that there is no delay in funding! I tried extremely hard not to step on anyones toes here but wanted to make sure things got signed correctly!

lender may kick it back for a re-sign...

same happened to me, a few weeks ago, and the lender was not at all happy with the 'added' signatures. tc had to redo the docs. i got paid in full - TWICE! hope that happens to you too!

Closing moved from 11am to 10pm-turned into horror night. 25 minute discussion over me not furnishing lender sample of my seal and copy of my driver's license, I told them I would provide a copy of my commission certificate, bond and E&O but that was all I would do because I was notarizing the borrower's signature not the documents. Then borrower says she won't initial the page because I wouldn't comply with the lender. Finally, got underwriter on phone at 11:35pm and they said I didn't have to because I wasn't a party to the loan, then borrower finally initialed. This lender is nuts, they say that they've had 5 fraudulent FL notaries in the last 3 months and that is why they want this info and that I am the only FL notary that didn't comply.

In my world, I can't locate ANY lender/TC personnel after 8:00 p.m. their time. Good for you getting a response.

well FL did have the highest mortgage fraud rate in the

nation....can you blame them for asking for this info. And I'd be curious to know who the TC is that hired you or the SS because it is on them to ask for proper notary identification before hiring the nsa.

I was told that the fraudulent notaries were in another part of the state. Yes, I sent copy of commission etc. to the hiring party. This lender was at the table and called her boss on her cell and they accepted me attaching a copy of my E&O & Commission certificate. Got finished at 11:45pm. I won't break the law even if the lender requests that I do, my problem is that I was told I was the first notary here to refuse their request. We aren't allowed to provide a sample of our seal for anyone. We aren't covered by any privacy laws so what do they do with the copy of our license? Identity theft is rampant, not giving them the copy.

I closed a loan for the same company

and did not provide a copy of my license to them either. The TC was not happy and threatened to place a claim against my E & O if the loan did not fund. I told them what they were asking for was not part of a notarial act, so an E & O claim would not be successful.

The loan must have funded, as I never did hear back from them and I was paid for the closing.

I am sure there are other Florida notaries who have refused their request, they just try and coerce everyone into complying by saying that no one else has refused.

also...

you have to wonder who in the past has been hired by this lender? I was working through an attorney, who was selected by the auction house to close the loan and the lender was mad because they couldn't choose the closer or title company.
