Jr.

I need some advice, I was at a signing Friday 10/1/10. The Borrower name is printed on all the documents as XXX Jr. He explained to me that the lady asked him are you a Jr?. He(Borrower) said Yes. But he has no ID that has Jr. on anything . I ask him do you have any ID that displace Jr. He said that No I Don't I really gone by JR. When the lady First ask me I said yes, because I m a jr . But I have never had any ID drawn up as JR legally.
So, my questions by there being no ID supporting JR. Do I Line thur JR and have him initial next to the mistake. please advise!!!.---I Thank you for the support I need.. I do appreicate this..

I would not change the docs at all - but I *would* line through "JR" in my notary certificates as, according to the ID presented, only XXX appeared before me, not XXX Jr. Thankfully in FL we have guidance in our manual in that we can state "acknowledged/sworn by XXX who represented to me that they took title (or WTTA) as XXX Jr and provided ID in the name of XXX as identification"

You should make no changes to the docs themselves at all without prior authorization from hiring party - only changes to your notary certs.

Is Jr. in front of you? where is Sr? If you have the Docs you can get the number to the TC and Lender, come on now, you can work it. Good Luck

This is fairly common & I run into it a lot. There has been discussion before, and people often don't have Jr. or Sr. on their ID, because it isn't necessarily their legal name. More often than not, they will have something with Jr. on it. As long as you don't suspect fraud (like a son posing as his father to take a loan), I go with what's on the docs. The variation in names is usually covered on the Signature/Name Affidavit, where they are swearing under oath about the difference in their name.
It's already been mentioned, do not alter the name as it appears on the docs.

I actually had this happen just this week. ID said Sr but not all the docs..Called TC they instructed him to sign MTG as Sr and some other docs without. I filled in the notary certs as whatever he signed..There was a name aff. in the doc package. Always check wit the hiring entity!

You stated "I filled in the notary certs as whatever he signed", Would this mean if someone signed John Smith but only had ID showing Tyrone McGee, you would fill out the cert with John Smith? I always use what ever ID says exactly for the notary portions. I never want to be asked in court why I would use any other name than what ID showed.

That's not what she meant, Larry. We generally complete the notary certificate with the name exacty as it appears on the docs (like John D. Smith & ID might read John Doe Smith).

I just want to thank everyone for their info on this matter. The borrower said that he has never really use Jr at all, there is no ID supporting Jr. So, I had him line thur and inital. The TC
gave no after hour number. so will see.
