Legal issues

If I need help with a legal issue... does anyone have someone I can ask?
Does a notarized form signed by two people that owe me money hold up in court rather than a note I faxed saying they don't owe me the money/not a notarized note?

I'm not sure I totally understand your questions so let me rephrase and answer and if this is not what you are saying, you can clarify and MAYBE we can get a better feel for this.

1. You have a form signed by 2 people who owe you money and it is notarized and you want to know if this will stand up in court.

2. You have a note that is not notarized that you faxed to ??? them???? saying that they don't owe you the money.

So, have you changed your mind? Do you now want to collect? Assuming that they are both dated, would the earlier dated item now be null and void (notarized or not)?

need more info....

I'm guessing your scenario went something like this:

-two folks signed a promissory note indicating that they owe you money (the note being notarized doesn't make it 'legal' so it doesn't matter), then paid you via check.

-you in turn, sent a them a note saying the debt was paid off.

-then the check bounced.

-and so now your pissed and want to collect.

Is this what happened?? If not please provide any missing info....

Thank You for all of your help. It was my ex husband trying to get me to write a note (which I am not going to do)... saying I would release him from his alimony so he can have more income shown to get a house loan with this new wife.
I had them notarize something saying the alimony is due and had it notarized. What was I thinking.?
I AM NOT writing him a note.... he will not get his house as he wanted.. and I will be blamed. Oh well.

Very smart decision!

Let him say it's your fault, who cares, sounds like he's really trying to just get out of a debt he owes. If he doesn't have enough money, how is that your fault anyway? Good Luck! :-)

Absolutely, wise choice!

If he doesn't qualify for the loan when the alimony obligation is included, he is STILL going to be just as financially lop-sided by PRETENDING (through fraudulent means, which you were nearly a party to ...)!

How can you change a "court order"?
Not with some paper signed even by the parties involved.
This would require a court filing which would need to result in a court order to admend the orginal court order.
PS Stand up for yourself. (Understand-I am a male who has always been around strong women and love it!!!)

His problems are not yours unless he is not paying your alimony.
Best thing you can do is shake off all those feelings of responsibility for his actions.

I agree with the others that standing up for yourself and removing yourself from his issues is the right thing to do. I know in AZ spousal maintenance (alimony) cannot be altered anyway without filing a modification with the court (not legal advice, etc.) Good luck!
