Missing Paperwork

Ok now not sure what to do. Signing completed last Friday, dox sent and rec'd on Monday. Wednesday Title Company calls borrower and says they never rec'd Power of Attorney. I have been doing this 8 years and never a problem like this before. My procedure for every closing is collect everything when I first get there. I do remember collecting the POA, Even had borrower look back through her copy to make sure it didnt get stuck in there, even though I do always keep dox seperate, Now what, I did have only one closing that day so nothing got mixed up. I always put that stuff on top of pkg, with copy of D/L. Now what. I havent talked to Title yet, they arent open for another hour.

I bet you that TC has it, but they misplaced it, left it on the scanner, put it in the wrong file, etc. I've been called a couple of times in the past, saying that we didn't receive this or that. Lo and behold, they found it on their end.

Hope they find it. But here is what I do with specific documents like that and checks - I always put them in a separate envelope, Mark the envelope what is in it and literally attach it to the front of the package. I even go so far as to do this right at the closing table so the borrowers can, if need be, testify to the fact of what I did. Knock on wood, never "lost" one yet. This is just a suggestion - maybe it will help prevent further problems.

I agree with Copper, it's at title somewhere. I don't know how many times I've gotten a call saying such and such document, check, etc. is not in the package and then get another call an hour or so later saying, whoops, we found it. Don't sweat it. The POA will show up.

If I'm reading this right, borrowers don't have it - they handed it over at the signing....

I'm surprised the original POA wasn't delivered for approval prior to the signing...that's how it's been done in all my signings....POA's have to be approved prior to clear to close.

My experience has been that the borrower has faxed a copy of the POA to the TC/Lender for approval. However, the original must be picked up when the docs are signed. It needs to be recorded at the county/city at the same time when the DOT/Mortgage is recorded.

Title did a search and found it, course they never said sorry for saying I never sent it. Yes they did have a faxed copy, but do need the original returned with dox for recording. Thanks for all your inputs.

YAY! Glad it had a happy ending...

but sad that they didn't apologize. Glad it was found and the stress is over for you.
