Question for Connecticut Notaries,

or anyone that knows? It was my understanding that CT required two witnesses on any ‘Vesting Deed’, (one can be the Notary) and none on the ‘Security Instrument’. I was recently told that two witnesses are now required on both the vesting deeds, and the security instruments? My info is from 2008, have things changed?

Not sure of your question, but

In CT, if you're looking at a document that has a title " xxxxx Deed" that will be recorded on the CT Land Records to secure a debt, it requires two witnesses and an acknowledgment block completed and signed by a notary, commissioner of the superior court or judge. If the xxx Deed is signed simultaneously before one witness and the person performing the notarization, then in addition to the notarization block*, that person can also sign on the witness line (aka 2nd witness).

In general, if the document is conveying any interest in CT real property and is being signed in CT, then 2 witnesses plus notary. The "rules" can vary if the CT xxx Deed is signed in another state or country.

* I've seen some recorded documents where it was later discovered the notary was the "2nd witness," but did not realize that s/he had to sign in TWO places ... both on the witness line and the notarization block signature line.

Sorry I wasn’t clear in my question.
So in CT 'Mortgages' are the security instruments rather than 'Deeds of Trust'? (Here in CO we use Deeds of Trust)

So if a mortgage is used to secure the debt, it needs to be notarized, and requires two witnesses to the signatures, one of which can be the notary? And I’m assuming this is also true of Warranty or Quitclaim Deeds?
So BOTH security instruments, AND deeds of conveyance require two witnesses?

Yes Les...CT uses a "Mortgage Deed"

as opposed to a "Mortgage"...

Okay… I guess I was wrong. THANKS very much!! I would rarely have use for such information, but it’s best to get it right.
