Question for VA notaries
I had a closing for a Virginia investment property this week, and ran into something I'd never seen in Ohio before. On the signature page of the Note was a notarial certificate, not acknowledging the signers' signatures, but certifying that the Note was the same as described in and secured by the Deed of Trust of same date. I didn't sign off on it, as I can't certify anything in Ohio, and it sounds like something that would need to be signed off by a lender or title company's notary anyway. But I'm curious - is this customary for Virginia notaries?

Hey Guys,
We have had lots of debates on what to do in this situation. Basically you are certifying that the information on the note, matches the Deed Of Trust. The problem that some notaries have is that it is not an actual notary document, unless add the other wording that makes it so,. Its a gray area that even the SOC will not clearly answer. Its typically on Wells Fargo notes and now starting to show on Suntrust as well as other banks. Why some do it and others don't..I don't know
If its left blank..I know the bank will reject it. Call your TC before sending it back blank. Sometimes you have to pick your battles.

I know Sharon asked the question and I am only answering for me and not trying to usurp her post. Thanks for the answer. On mine I didn't fill it out, I attached an ACK that I witnessed the signature.

Sounds like something for the Settlement/Closing officer to certify at the TC or the Underwriter. I wouldn't sign this at all. Interested in hearing others take on this.
