wording on NotariesExpress instructions
I just got an assignment from NotariesExpress. This is a first from them. The 3rd sentence states, "NotariesExpress can no longer pay for files that do not fund." I replied, that unless they waive this sentence, they need to find another notary. How do the rest of you feel about this. I can't ever remember seeing this from any other company. How do they think they can do that?

That was quick, I just got a phone call back from them saying they would amend my confirmation, saying that they would pay me, so I guess I have no concerns.

I'd be saying, "who are you talkin to"? But really? They can say what ever they want,...they're the hiring party! I think if they can get someone to work for $65 dollars, then they should call that person everytime. Just stop callin me!

They didn't hire me for $65, I hang up and laugh at those calls. I don't do them. I stick to my guns.

I have seen this statement in signup agreements with other companies also. I line it out and initial it and replace it with this language:
"No contingent fees; no-signs, no-funds and recisions are out of my control. PA Notary Law Section 19(3)(e) states 'Section 19(e) No notary public may act as such in any transaction in which (s)he is a party directly or pecuniarily interested. For the purpose of this section, none of the following shall constitute a direct or pecuniary interest:. . . (3) receiving a fee that is NOT contingent upon the completion of the notarized transaction.' (Emphasis added). Therefore, my fee cannot be contingent upon the completion of the notarized transaction. If the borrowers refuse to sign or sign but later rescind and possibiliy resulting in a re-draw which I perform, I am to be paid for both signings pursuant to the Notary Public Law."
And if they continue to call me, then that's ok with me. I cannot even accept an assignment if the fee is contingent upon the completion of the transaction.

Wish we had that in our Notary law section-that would be a very benefical change here and probably every state. It's not our fault if the loan doesn't fund and we did our part.

I have to agree with that - I am almost willing to state, minus statute citations, something just to that effect on each and every confirmation that I send back.
