Blue ink versus black ink

Did a Bank of American signing today and signed in black instead of the blue ink they requested. Is this something that I should go back out and have resigned or is it not that important???

The instructions were for blue ink. Didn't see it until I was ready to send the signed documents back

Well then, IMO yes, it's *very* important...and looks like you'll be going back out on your dime to fix it. Unless you want to wait and check with title tomorrow morning....but IME when they say blue, they mean blue; when they say black, they mean black.....

Before you go back out to re-sign, call the lender or TC

and ask if it's okay that you didn't use the right color. Sometimes it's just a preference, other times, it's a requirement of the county/state.

IMHO, yes you should go back out. So that the borrowers don't think there's any funny business going on, give them the docs signed in black.

Well the lender is not going to get the docs tomorrow,

so you could wait to call the lender or TC tomorrow. Problem is, will the borrowers be available to re-sign tomorrow if the lender/TC say YES, they need it in blue?? If they are signing on a Sunday, odds are they have tight schedules, and to wait until next Sunday to re-sign will probably NOT do... IMO, if the borrowers are able to re-sign tomorrow, I would wait til tomorrow to check with the lender/TC. If they are not available to re-sign tomorrow, I would go back out today. Ultimately, you have to decide, but that's JMHO.

Try hard to get a hold of someone at Title

Start calling and if you can't get a clear answer then you need to get back over there. You don't want to risk a borrower losing there rate lock or the end of month cutoff.

Call & ask. Dollars to donuts, they'll sternly say "OK, this time" and you won't be re-signing in any color. (Unless, of course, this is some state/county requirement--which I doubt.)

I guess I have the "Provident" mentality.

and I really need my 7 hrs of uninterrupted sleep every night. I know in this situation I would have spent the first few hours in bed thinking about the "what ifs" before I let it go.

Even had the 3 color signing once (docs sent to BO - they signed before I got there in Black and green). Couldn't switch out as one of those packages that the BO's get less than what they signed.

Called immediately upon noticing this, was told ok, not to worry.
Have had instructions from SS saying sign in Black, then see Blue in Lender instructions.
Two nights ago had Sign in Black on their page from bottom of stack - all done in blue and sorry, blue is fine in FL and I wasn't going to get redone, but made the call next day and it was ok.

So...what I am saying is: ask before you go any further. If you have to wait till Mon and the bo is not available for resign, my thoughts are that they will accept them anyway.

But that is just me and my experience - also opinion and free advice and we all know what that is worth.

Nobody really seems to care

This is almost always a lender/TC preference, and on the one time when I did it, nobody really appeared to give a flip.

Before I inconvenienced the borrowers by making them go through a complete new signing, I would make absolutely doubledamned sure that somebody really cared. The borrowers are not going to be at all happy about a resign, and their unhappiness is probably not going to stop with you. The lender knows that, and my guess is they'll want to keep their borrowers smiling.

I've done it more than a few times over the years and never heard boo about it. I wouldn't make another trip unless requested. I'd just call someone at the t.c. as soon as possible to let them know. Bet they'll say not to worry about it.

I was once told by a loan officer at Bank of America, that the color did not matter, it could even be in pink, as long it was used for the entire packet. Often is not the bank that requires rather title.

Resigned

Went back out signed in Blue. Borrower was very understanding. Better to get it right than have to call tomorrow and be told to resign. Documents might have had to be redrawn with the new date on them and everyone would be unhappy.

Glad you fixed the mistake. Whether or not the TC will just accept the docs signed is black is SO NOT THE POINT......they asked for docs signed in blue (per their written instructions) and that's what you're delivering...GOOD JOB!!

Good job...take it as a learning experience you'll

become a better Notary for it. I once did something similar because I trusted the person I got the Docs from (incorrect date on Docs) and had to go back out. That BWR too was understanding. My credo....If you knew how to do it right, why would you do it wrong?

Beats me --I always thought BOA wanted blue and until I got to umpteenth page of instructions from SS didn't know they wanted black. Cannot change from SS to SS so I think as long as you follow state requirements you are OK.

I would not go back out

This happened to me once that I know of anyway and during confirmation I let them know and gave them the option of letting me know if this was going to be a problem I would immediately go back out and get it resigned in the requested ink color. The response I got was "Thank you for closing this loan for us you can expect to receive payment within 30 days".
