Collection Companies

Hello all.

Anybody ever use a Collection Company to get the money owed them?

Can anyone recomend a company that can get results?

Have used D & B for 35 years.
Just the threat of turning over account many times proves to be effective.
Debtor knows that it will have adverse effect on their credit.

I tried to collect from Signed and Sealed for three closings D & B said they don't do collections anymore. I haven't found a company to handle small debts.

Do it yourself.

Contact the TC and the lender and advise them that you haven't been paid and will start legal action for unjust enrichment if you have not been paid within 10 days. You did your job, those upstream in the food chain got their's, but you're left holding an empty bag, no way. If the TC or the lender says they won't use you again, so be it. Their probably sleaze ball also and we don't need to do work for entities that don't pay. It's just like a general contractor. If they sub out work, they are responsible to see that the payment flow downstream. I don't want to hear that they lost money. We are not partners in their profits, so why should be partners in their losses.

Thanks for the suggestion, That has all been done.
The time is now for other, more serious actions. The big problem is that the company in question is not near me, so me me to take them to court, it must be done in their area. Which after I make a trip or 2 I will have paid out more than I would get back in court.
So, Now I use a collection agency, if I can find one that does not take what I am owed as their fee.

If you contacted the lender, TC, SS and still got no response then do a little research and see if the lender has offices in your state or better still county. Then you can serve them there. No lender wants a court fight over a couple of hundred dollars for this.

If the claim is for $100 to $150, be prepared to let that go, because an outside collector is going to want a third, but would require an up front retainer against future proceeds. This might cost more than it's worth.

One of the attorneys I network with told me that the jurisdiction (where you can sue) is where the contract was performed...not where the company is located. The loan signing was performed in YOUR area, therefore, you may be able to file in small claims court in YOUR county.

If you've contacted the TC and they used the "we paid the SS so it's not our problem" excuse....contact the state department of insurance in their state and file a formal complaint for financial irresponsibility, unjust enrichment and collusion. TCs must be held accountable for partnering with SSs that do not pay the Notaries. The TC owns those docs, not the SS. The TC generated the docs, not the SS. The TC receives the signed and notarized loan docs, not the SS. The TC is ultimately responsible and the bottom line is, when they partner with deadbeat SSs, they will pay twice for the signing.

Draft this letter and fax it to the TC, dated 5 days into the future. If the TC doesn't respond, follow through and send it certified to the state insurance commissioner (or department of insurance - whichever it's called).
