Just got a call.....

for GNW. Woman said she had a BofA seller doc and BofA would not allow her to use a UPS notary. (Fallout from FedEx? How would the bank know who notarized it, anyway?) BofA also would not notarize its own document because the woman did not have an account there. Her bank wouldn't notarize it because it was a BofA doc....

Limiting liability?

Anybody could have done it, somebody should have done it, but nobody did.

The banks are probably limiting their liability, for reasons well known to Federal Express.

Discrimination?

It might be interesting to listen to a conversation in which the BoA rep explains to the Secretary of State that he/she refuses to accept the notarization of someone the SoS has designated a Notary Public, and how/why that decision was reached.

BofA can limit notarial services offered at it's locations. Nothing says the notary can't do it (perform Notarial services - sheeh) off site and during off hours.

§ 8202.8. Private employers; limitation on provision of notarial services
Notwithstanding any other provision of law, a private employer of a notary public who has
entered into an agreement with his or her employee pursuant to Section 8202.7 may limit,
during the employee’s ordinary course of employment, the providing of notarial services
by the employee solely to transactions directly associated with the business purposes of the
employer.

Beat me to it, Rick! ;>)

I couldn't get the test highlighted when I brought up the PDF from the SOS website and had to type it in. I could have sworn that I've done a cut and paste from there before... Were you able to do so? [I wonder if I have too many things open on my pc right now -- printing docs, etc, etc. -- and if it could be a memory problem??]

Under California law, that may not be a problem:

8202.8. Private Employers; limitation on provision of notarial services
Notwithstanding any other provision of law, a private employer of a notary public who has entered into an agreement with his or her employee pursuant to Section 8202.7 [which addresses employer paying for costs related to acquiring employee's notary commission] may limit, during the employee's ordinary course of employment, the providing of notarial services by the employee solely to transactions directly associated with the business purposes of the employer.

My first Discrimination comment above refers to BoA

not accepting notarization from a UPS Notary Public. If one company wishes to refuse state appointed notaries, that seems to be a bit selective. Didn't realize anyone would be so bold as to say, in essence, "you may have been approved by the SoS, but we'll not accept your acknowledgement because you work for such-and-such company. " Seems a bit selective, perhaps not really discriminatory.

Exactly, Jack. So the big question is: Why? What is it about UPS notaries that BofA doesn't like? Besides the fact that every UPS notary I've had to use is a bozo. But who's to say that a non-UPS notary can't also be a bozo? Maybe there's something else going on ... like a business relationship - or they're mad at each other .. very weird. And, as I said originally, how would BofA know who the notary was?
