Late docs

Closing half hour away no docs. I called title person said...we don't know what time they come in. What do you want me to do lie to you and tell you that they are coming within a certain time? Then he went to tell me how it works. He acted like I was intruding on him. He said well call borrower and keep him posted. I said I have other appointments. He said then we will just get someone else?

This situation would never happen if you give these rude title companies a 3-hour deadline. You let them know when you are hired....have the complete & final package to you 3-hours prior to the signing time.

I really got fed up with this title company game of thinking the notary has nothing to do but sit around and wait.

Talked with a TC just today about this. She understood completely. She also told me she had an in house purchase closing and borrower was there ready to go, but no docs. They were an hour late also. She was also aggravated. They were still waiting for lender. So, it happens even to them, not just us.

happens to the Lender as well. Happens all the way up and down the ladder. Nobody likes it any more than we do, nobody. It's not laziness, it's not a lack of respect, it's not dropping balls all over the place!

I wouldn't trade places with any ONE of those poor souls for nothing. This is a cake walk compared to that.

Thanks, Renee. I wonder if anyone will ever get how it

works in this business. If you don't have the flexibility or can't move your schedule, let them know to get someone else.
I know I am always asked if I can still do it when there is a change in time due to docs not
being available. I can either be in a position to accommodate or not, the choice is mine. It's all about how much business I'm willing to let go to someone else.

If you're willing to wait (I wouldn't) contact the borrower as he suggested and be polite. Let them know what's going on. The borrower will let you know what should be done by their actions....follow suit. IMO

It's nice that everyone is so charitable and understanding, but we have lives and schedules also. I have found, over the last 11 years, and especially the last year, that the lender is the biggest fly in the ointment. The loan officers (some are children) try to take on too much. As a result, the borrower has little or no communication with the loan officer, the loan officer waits until the last minute to finalize the paperwork and once that is all done, the lender team sits on their hands when the final HUD is sent to them for approval by title. The lenders have little care for the title company or the notary. Title companies won't make a fuss because they are afraid of losing the lender, so you are up against lenders that don't care one way or the other, and title companies that are trying to keep all the balls in the air - and signing companies, they know little or nothing once the assignment has been made, except those that forward documents to the notary. They certainly know when they don't have docs, and there's not much they can do either. Some of my very best customers are held hostage by lenders bumbling around instead of attending to business. So, here we are at the bottom of the food chain. Each notary has to make a conscious decision to either accept these increasing irritants or just tell them they have to get another notary.

That's when I tell them I'm charging them for late documents, and they would have known up front I was going to charge them if it happened, too, because with very few exceptions, all of my confirmations back include the fact that is docs are delivered to me by a certain time period before the appointment, i reserve the right to not only reschedule the appointment, but charge a late fee too.

Amazingly enough... I don't deal with late docs all that often. Most companies who call me know not to go down that road with me because I won't take it. I refuse to accept the mantra of so many that "it's the nature of the business" -- no it's not. It's lazy people who aren't doing their jobs, and I'm not going to pay for somebody else's irresponsibility.

I do the same thing, Marian. When I accept a job, I email the company immediately with my TERMS. (They give us their terms...well, I give them mine!) That way, they know I have a 3-hour deadline for final & complete docs. They know if they don't meet the deadline, I take the signing off my schedule and go about my day, and they know that when docs come in, they will have to call me...at which point i will charge AT LEAST $25 more.
I've learned how to deal with these companies by being dumped on for many, many years. I do things in a way that works for me....and if companies don't like it, they can call someone else. I'm okay with that.

By the way, a few months ago, some new company hired me, agreed to my terms and got docs to me in plenty of time. An hour before the signing, they called and said the docs had been changed and I needed to print them again. I said, Okay, send a new confirmation for an extra $25 printing fee and he said "No can do". So I said "No can do". And, I charged them $25 for a printing fee and let them find someone else. They paid my fee.

If docs are late, I call the hiring party and give them the option of (a) taking the job back and re-assigning it to another Notary or (b) their job goes at the end of my schedule - *whenever* that is. Totally unnecessary and a waste of energy to get frazzled, upset, frustrated, etc.....I just move on and continue the rest of my day.

Not a big deal.....not a federal case. Don't whine about late docs....just move on........

This was a title company that had not called me before. And, today was a reschedule last time it was canceled at last minute. I ended up asking them to send someone else. It won't surprise me if they call me again for same one.
I don't think it should be up to us to be calling the borrower and not be able to give them a time frame.
