Does a Re-Fi on a Mortgage in Florida require witnesses? Borrower's in California.

Mortgages don't require witnesses, only deeds in FL. Maybe somewhat from FL will confirm this?

What county....despite statutory requirements,

Dixie County requires two witnesses on mortgages - I think I read elsewhere that there's another county that requires them...can't find it at the moment but will look.

LOL Linda! I hear you, it was seven days a week for me being a Crew Leader Assistant. I am not concerned about this FL property. If they wanted witnesses, they should have told me and the borrower is responsible for getting them.

They weren't told this and they saw the docs for the first time, when I presented them last evening. No GFE, nana, nothing, zippo. Gotta love it.

Some lenders/tc's want the witnesses, whether required or

not. I guess they feel it's better the play safe than have a DOT that won't record.
The instructions usually specify if they want witnesses. The notary can be one witness.

I did a closing where, in the instructions in bold red letters it said: The Notary is responsible for getting the witnesses". I called them back and said if that is the case I need another 100.00 so I can pay the witnesses. Guess what - they decided that witnesses weren't necessary (and this was a refi, not a conveyance of property - which I know two witnesses are required for a conveyance of property in Florida and the notary can be one of the witnesses).
