Arizona Notaries doing Jail Notarizations

Recently I was informed by the reception desk at one of the Phoenix facilities that last month approximately 1,000 notaries came to the jail and notarized documents simply using the booking number or arm band as identification and this happens every month.

Notaries: Please look at your Arizona Secretary of State Notary Public Reference Manual Page 15-16 or Arizona Revised Statutes 41-311. Booking numbers and jail issued are bands are NOT acceptable forms of identification. You are putting yourself in great jeopardy here. This Manual is available on-line at Ken Bennett - Secretary of State website (http://www.azsos.gov).

I have had several notaries tell me that lawyers have even told them it was OK. This is not true. Since I receive this question so much of the time, I thought I would share the answer.

Have a Happy Day!

Really?! This happens all the time by AZ notaries? Not saying it is not true. I am just surprised that "1,000" AZ notaries would not know the proper way to ID an individual for our state. As far as lawyers telling them it is okay......that makes me laugh. I have been asked questions about notarial procedures many times from lawyers I do work for. Thanks for posting this!

Didn't see any polish on his nails. He was a male guard.

Do you think there are 1,000 notaries in the phoenix area?

I would imagine there is

I am sure Tampa has well over 1,000, and Phoenix is a much larger area than Tampa.

Well over 1000 in the Phoenix area.

It's a huge metro area.

Thanks Shoshana...I was just trying to figure out how many notaries were at the prison on any given day since "that" guard can't be everywhere. And How many prison facilities in the area? I have never seen another notary at our county jail.

I used to go to Santa Rita all the time when I lived there. Sometimes i even got called to go to the FCI in Dublin.
