Linda is totally correct and has linked you correctly to the CA Handbook. Perhaps you might want to read it.

Re: Thank YOU Florida Notaries, Any CA Notaries out there?

No! BTW We are all notaries first the state specific second IMO. When asking for help, even. The Notaries responding to your question are actually trying to help.

I'm a California notary and I think also it is something you most likely should have known,...other Ca notaries will tell you the same thing as they read your post.

Re: Thank YOU Florida Notaries, Any CA Notaries out there?

I am a California notary. I would love to help you. No, this is not a legal jurat for California...please check the link that Florida notary gave you...you will find correct wording on page 12..as she stated....

No, Don't take this wrong, it's a 'fun' ? not a 'help' ?

I was hoping to get responses from CA notaries, because I'm sure they've seen this Jurat before!

I just received my commission from the SOS (renewal). In order to start using it we have to file our oath at the county office. Right?

Or

We can send it in by certified mail, if we have a notary public administer the oath.

THIS IS THE EXACT WORDING ON THE JURAT THE SOS SENDS TO QUALIFY THE NEW COMMISION!! Ha!

I just thought it was a hoot!!

Ok, guys; no more coffee for you, a Thank YOU guys is a Thank YOU guys, and chastising not necessary. :0)

I took my test in Feb, I'll be looking for that on the letter I'm waiting for to file my bond and oath with the county. Thanks for the alert.

Took my test in Feb!

James I took my test in February too. Was really sweating it because my commission would expire on April 5th, and I was concerned about the lapse.

Which it did, but not because of any delay with the SOS. They sent my application back to me for a correction, because someone here made a mistake on her own birthday!! Filled in 06/12/2011 instead of 06/12/1959. If it had gone through I would've been (on te books) the youngest notary ever! HA!

have a great day!! I'm off back to pulling weeds in the flowerbeds. Love all the rain we had this year, but so did the weeds!!

Re: Took my test in Feb!

My comm expires June 2011, not sweating though....with the way things are going, they just may do away with the SOS here. We'll have to go to Walgreens or the other Wal.........LOL

Do as I say, not as I do

I've also seen many CA state gov't forms with incorrect notarial wording. *Sigh*

See Msg #366792 for a previous discussion.

Discussion from Jan, 2011 re incorrect Jurat wording on governmental forms.

Apparently County Clerks do not have to comply with the same rules as California notary Publics so they can legally use a different Jurat language. Stupid? Yes.

Re: See Msg #366792 for a previous discussion.

If I take this to the county clerk then they're not necessarily notarizing the form. They are certifying that the oath and bond were filed on a certain date.

However if I file by mail; then I'd need to have my signature notarized. Twice actually, 20 dollars anyone? Which means any Notary, not necessarily a county clerk. I wonder how many Notaries would attach a loose cert?

I would. :0)

I think it could be the budget crisis

It probably costs lots of $$$$$ to redo and reprint all of those forms. They probably figure they (or we) can just attach a loose cert or stamp on the correct verbiage, if room. Frankly, I think it's a good decision, even though it seems pretty hypocritical at first blush. Wink

Re: I think it could be the budget crisis

I haven't seen anything in the California handbook that allows the SOS or County Clerks to use a different wording, and the law has been in effect for over three years... you'd think they MIGHT have had to reprint their forms at some point during that time, but maybe not. Maybe they printed a 10 year supply six months before the law was passed.

Re: Do as I say, not as I do

As have I, and I am a California notary... Most of them are from local government agencies (cities and counties). When I see them I attached the correct form, and put a sticky note on their form that they do not have the proper notarial certificate and refer them to the SOS office for more information. I don't alter their form, except to stamp "See attached California acknowledgement/jurat". Haven't gotten any flashback from any of them yet.
