Printing Instructions

If an edoc and the email it comes in, does not come with printing instructions, whether some pages should be in legal, others letter, should I automatically assume that I print all in legal?

Also, blue pen is the default color, correct?

Matham, one of the questions you asked is answered just a few threads down this page. It's a good idea to keep up on your reading here and always do a search before asking questions. The ink color issue has been discussed many times, as well. Your answer will depend on circumstances and location.

If you can print both legal and letter size, do so. If not, print all legal.

As far as default ink color is concerned - there's no such thing. One of the counties I service here REQUIRES black ink on recordable documents; the other prefers it. I have had signings with instructions to use blue ink only, and have had to call the hiring party to inform them the documents will not be accepted that way in this particular county.

Your best bet is to familiarize yourself with the recording requirements for whatever counties/municipalities you will be signing in so that you become the "expert" for your clients; chances are they won't have a clue what those requirements are, and you can save yourself (and them) some grief and additional work.

There are exceptions to every rule. I have on TC that sends docs in ltr and lgl, with the instructions to print in all ltr!
It all depends is the answer, check with the hiring entity on size.
As for ink color, that is usually dependent on the state/county. In Illinois it is all black, as it is with several other states.

Why is it that the e-docs sent to me have more than 10 Rights to Cancel forms? They're all the same. Is this normal? Do they really want to drive the point home that they have 3 days to cancel?

It doesn't matter *why*....get them all signed and return them with the package. Double check to ensure that the transaction date (the day the docs are signed) and the rescission date (3rd business day) are correct.

If the date(s) are incorrect you will do one of two options **depending on your instruction sheet from the TC**. The Notary will line thru the incorrect date(s) and hand write the correct date(s) and have the borrower(s) initial. OR...the borrower(s) will line thru the incorrect date(s) and write in the correct date(s) and initial.

Again, depends on the written instructions from the TC as to who will make the corrections.

A couple of years ago, in the hayday some people refi'd every 6 months and took out equity each time. At that time there were several lenders who put in 6 month interest penalties if you paid off early.

A case arose where someone wanted to refi but not pay the penalty. He claimed that he never received a right to cancel and that the whole refi should be voided. The lender could not find evidence that he had received the RTC (lost paperwork??). Borrower got to void the loan and refi with no penalty. So, now there are multiple multiple signed RTC so at least one can be found if necessary.

Absent instructions to the contrary -- and I have never had such instructions -- I return only one RTC per borrower if they are individualized, and only one if all borrowers sign off on the same RTC. Never had a complaint.

Lender instructions were clear to the letter; every page of the document, whether there was a line for it or not, needed initials by the borrower. Thank God I started with the Right to Cancel.
