Titleserve Returned Check

Just got message from my bank that the check I deposited from them was returned unpaid. I did this deposit over a week ago, so anyone else who got a check from them will probably have it returned.

Wonder if we can claim intentional fraud in this mess. During my last closing, I had a call to fax entire closing docs immediately after the closing. Told them I could not as I was not near a fax and had other closings. Was told it HAD to be done by 1. New lender requirement.

Obviously they knew they were shutting down when gave this new instruction, obviously they knew I would not be paid and yet they pushed for me to do the close. Theft of services.
Seems pretty clear. Nice bag of money stolen from little notaries in 47 states!

Wonder if our wonderful association is doing anything on our behalf?

The Connecticut General Statutes provide for recovery of a bounced check. Send your client a letter by certified mail demanding payment of your fee and bank charges within ten days. If you do not receive it turn the matter over to the police. The police will not move on it until you show them the certified mail receipt or the unopened letter returned as non-deliverable. However, once you provide that evidence to them they will move on it. I had a client they went after for a $25.00 bounced check.

Once they take the case you may be reimbursed by either a crime victim's recovery act, or the prosecutor may plea bargain it down to a lesser charge on condition that they make restitution to you.

If their checks are bouncing, then I'm sure their UPS charges will bounce back to the notary as well, á la the EFS fiasco from a few years back...

I don't list my information on the UPS forms. I put the company that it's being sent to as the sender. How will those bounce back on us?

If I have not been provided with a shipping label by the TC, I do as you do with a handwritten label. TC is listed as both sender and receiver - my info is nowhere on the label.

However, many notaries still use the online label generator from their own UPS account. If Titleserv does not pay their UPS bill, the shipping charges will bounce back to the shipper.

They can also bounce back to to the notary used their UPS acct to order the labels as well. Even if they used the TC address in the return section.

With the new UPS requirements you cannot use a written label and put the other company's name in the sender section any longer. That's one of the reasons I now refuse to send anything UPS when I am only provided a UPS account number.

I've had UPS charge me before. It was taken care of by the TC, but still, once bitten ...

Not if you didn't put your name on the shipment document. This has been discussed many times. Do not put your name or address on the label. And don't sign you name so it's visable. UPS told me if the shipment isn't paid if they can read your signature they will find you and charge you the fee. That way you won't get hit with the charges.

Just got a letter from my bank saying their check was returned for "NOT SUFFICIENT FUNDS". Any ideas on how to proceed at this point? I am out over $500.00. I will a complaint with the NYS Attorney General, but bottom line is I want my money.

janie/vt and SunnyD, file those charges ASAP before this company files for BK. They've closed their doors, and closed their bank accounts or they're out of money. Either way, looks like their heading for bankruptcy.
