Any FL NotRoters around Sanibel wanna marry me?
Will be vacationing on Sanibel next month, and looking to renew vows with my lovely bride of 31 years.
Would prefer to have a NotRot colleague officiate if anyone's in that area sometime during the week of Sept 11.

Since you don't need to be a minister
to officiate at a renewal ceremony, my guess is that anybody can do it!

It does NOT have to be a person who is legally authorized to marry people who conducts a vow renewal.
As long as a couple is already legally married, anyone can stand with them to act as their officiant. They key here is to be certain that the couple really is legally married.
A vow renewal ceremony looks approximately the same as a wedding ceremony. Some couples use a vow renewal to hide the fact that they were legally married secretly, so they want the vow renewal to look and sound like they're just getting married.

I consider it fraud when a couple leads an audience to
believe they are getting legally married when it is only an unofficial vow renewal, and I will not participate in such ceremonies - nor will many other wedding officiants.
Our handbook is quite clear - no vow renewals for notaries.

Florida notaries can not perform a marriage without a
marriage license. You can not obtain a marriage license for a vow renewal - because the couple is already married. It is the same as same sex marriages (p53 of handbook). Because a same-sex couple can not be issued a marriage license, a notary can not participate in a safe-sex ceremony in his/her official capacity as a notary.
There is one exception - there is an old attorney general opinion that says that while the license is valid, mulitple ceremonies may be performed. Of course, only one can be recorded on the license - you would have to attach a second certificate of marriage I suppose. But this only applies within the sixty-day period during which the license is valid, and assuming that it has not already been returned to the clerk of court.

Heck, when I was a kid , "safe sex" just meant not doing
it in a moving car. Not familiar with FL law, but as others have said, a vow renewal can be done by a bar tender or bellhop. If notry is not acting as a notary, I don't see why just anyone , or even just the couple themselves could not do a vow renewal. Roger just wants a fellow notroter to be there and do his/her thing as a co-professional. Any notroters near Sanibel interested? Rog may even pop for lunch. I have met his wife is she is a very nice lady.

Again, nowhere in Florida law are clerks authorized to perform an vow renewal. Just because it isn't specifically prohibited doesn't mean they are allowed to. Clerks and notaries alike can only perform those duties awarded to them by the legislature.

Robert, I have performed many vow renewals. No one in the audiences were under the impression that the couple were getting legally married. All the guests knew the couples were renewing their vows. There is nothing in the Florida Statutes or the Governor's Reference Manual that prohibits a notary from performing vow renewals. There is nothing that needs recording or needs notarizing. Please show me in the handbook where it states no vow renewals for notaries.

With notaries - if the law doesn't speicifcally authorize you to do something, you can't do it. Using your logic, just because the law doesn't PROHIBIT notaries from issuing arrest warrants, that means notaries can do it.

I would think that if anyone can do something , then a person who just happens to be a Notary Public, can also do it, so long as they are not doing it in their capacity as a Notary Public.

I would agree with you Bob, but I think Sylvia is
claiming that a notary can perform a vow renewal IN HIS CAPACITY as a Notary Public - and this is quite obviously not authorized by law. Notaries can not perform duties with which they have not been empowered by law.

reply on her behalf. Since a vow renewal is not any type of official act. then if a person who happens to be a Notary elects to participate, then it would not be illegal. No more official than tosting the bride and groom. Just because a notary public is authorized to perform certain official acts , does not mean that a person who just happens to be a notry can not do some unofficial act , unless the law requires that a the act may only be performed by an authorized party . If you don't choose to be there, then don't. Roger just wanted a fellow NOTROTER to be there to "officiate"
