Justice Title and Escrow-Fairfax VA

For those of you who don't visit 123. (I sem to be getting a run of deadbeats, lately.)

I did a signing for them on Nov. 14th with an agreed upon pay date of 15 days out. It’s now Dec. 17th and I still haven’t received payment, though I’ve called and emailed them asking for it.

At about the 21 day mark I called Monique Morgan, the closing agent who hired me, and asked where my check was. She became quite terse when she heard my question and responded with an attitude of ‘how dare you call me and ask for money?’. She immediately said, “I’ll transfer you to our accountant”. Before I had a chance to say anything, I was sent off to another extension that rang several times without being answered. I hung up and called her back. When I told her the extension she transferred me to was unattended, she didn’t say anything at all. I was getting the cold-shoulder/silent-treatment at this point. Finally I said, “You hired me for this job and I want you to follow through to see that I get paid, just as I followed through with signing and returning your docs”.

There was another long pause, after which she said, “The accountant is off today.” When I asked why she transferred me to him if she knew that he wasn’t there, she again didn’t answer. Instead she said, “Send me another invoice and I’ll give it to him when he comes in.” Before I could ask when that would be, she hung up on me.

In any case, I emailed her another invoice immediately after she hung up. That was 9 days ago and I still haven’t received payment. I did, however, report Justice Title and Escrow to the BBB a few days ago and hopefully will get some results. Beware.

It's very bad news when a TC doesn't pay. So everyone can see ratings, make that 'servicing all states' because you just never know when they may need a notary in any state.

I've tried adding to SC before - it won't let me because

some of the employees at Justice Title have listings on NotRot and the fax number on their listings is the same as the fax number for Justice Title. The system rejects it due to the duplicate information.

I doubt you'll get any results from reporting them to the BBB. If Justice Title & Escrow are truly a title insurance company and an escrow company and it's not just in their name, they have regulatory agencies - in CA they're called the Dept. of Insurance for the TC and Dept. of Corporations for escrow companies. Not sure what VA calls those two depts....google them.

Here's my suggestion: Write three letters - one demand letter to Justice T & E.....one to the Dept. of Insurance and one to the Dept. of Corporations. In the demand letter, give them 5 business days to FedEx your check to you. Draft the other two letters to the regulatory agencies as a complaint for non-payment by Justice T & E. Include the facts, details and circumstances of the non-payment. Date those two letters the day after the 5 day deadline from the demand letter. Don't mail the two letters to the regulatory agencies, yet. Include them with the demand letter to Justice T & E so they know you are not playing games.

Send all three - demand letter and two complaint letters to Justice T & E. Send them four ways: certified mail, snail mail, fax and email. If you do not receive your check within the 5 days, then follow through and mail the two complaint letters to each regulatory agency, by certified mail.

Did 6 jobs in 2011 for them, first time getting paid took 30 days. They lost my invoice and was paid quickly after second one. All the jobs after that payment was within 15-21 days.

Interesting. I live right down the street from them...I mean like 20 mins away but was just in their area tonight. I know irrelevant information to you but I could show up at their door if I wasnt getting paid. There is a demand letter offered here on Notrot which worked great for me on several occasions earlier in my career.

Best course is to notify the Dept of Insurance in their state, they are not dispersing funds from HUD statements as required by law. You may get a call and be surprised to either receive payment. they may be subject to an audit. They don't want this to happen.

Did a signing for them on 11-2-11, received check 11-18-11. They've always paid me in a timely manner. Hope this isn't a sign of things to come !!!

I have worked for Justice Title and Escrow for a long time. At first they were paying upon funding then changed their procedures to about 3 weeks out. I've never had an issue with them not ever.

Thank you all for these great suggestions. (Unfortunately, I can't seem to edit 'Fairfax, VA' to 'All States' at this point.) I like the '5 day demand letter', notice to the Det. of Ins. re the HUD and have already written to The Sec. of the Commonwealth of VA. When I send the other suggested letters (whew), I'll update here if I get any results.

Is it just me, or is the hardest part of our business getting paid?
