Written instructions vs Verbal Instructions

Closing conflict. Two closings from affiliated signing services. Second one interfered with first. "Scheduler" on second asked me to work out new time with borrower. Confirmation for second signing comes in with old time, no mention of "working out time" or "tentative". Confirmation also has paragraph that says any change in time by notary would mean decrease in fee. I try to get BO but only have voice mail. I call SS and they say don't worry about what the confirmation says, its okay to change time. End result: I ask SS to schedule with BO and email new confirmation with time of closing. I ask that they handle the scheduling and I will accept or reject the closing according to my schedule. Half hour later I get a cancellation notice, they set it up with another notary. I think I handled it appropriately under circumstances given.

I agree with you - IMHO, you handled it appropriately AND....you may have just shed light on another scheme by some companies trying to reduce fees. Company says one thing in confirmation and says another verbally. They won't put in writing what they say verbally so they can blame it on the notary and then try and stick to the rules in the confirmation. Then they have "amnesia" about what they verbalized.
