Electronic Notarization - Yet again!
Here we go again, this should not be allowed to happen. Virginia is working on a bill in the Senate to legalize Total Electronic Notarization via Video. See the link. You cannot do your Notarial Duties via video. How are you going to vet the ID, check for awareness or duress? Yup - the house and senate bills are progressing... our brilliant legislators seem to be voting this idiotic idea in. Hopefully our governor will veto it.

Glad to hear there was some opposition presented
this time - the two previous hearings the opposition was pretty weak, all in all..

I think the notary association is the NNA, and for once, I sincerely hope they file a lawsuit against the state if the law is passed...
The reason for the law is ridiculous and totally w/out merit...
This guy Chip must of cashed in on LOTS of favors to get this passed by both the senate and the house...
...maybe he's originally from Chicago...

here is the lobbyist behind the Bill -His name says it all!
John G. "Chip" Dicks, Manager of FutureLaw, served as an elected member of the Virginia General Assembly during the 1980s.
Since leaving the Legislature, Chip has represented associations and businesses on administrative, legislative and regulatory matters before state government agencies and the General Assembly.
He has substantial experience in representing developers on a variety of land use applications in a number of localities in Virginia. Chip has expertise in the laws and regulations affecting billboard signs and in the field of landlord tenant and fair housing laws.
Chip is a seasoned professional who helps the client identify and refine strategic goals, and then establish an implementation plan to meet the client's timeframe for completion of a project.
Outside of the practice of law, Chip is an active real estate investor through Capital Realty & Investment Company, and is an owner in a number of private companies including an eNotarization company, a wireless communications company and an alternative energy company.
Pic of him here...

He definitely has a PERSONAL INTEREST in this bill being passed...being a REAL ESTATE INVESTOR and all.
Why can't the VA legislatures see that this law is going to make VA the place to go for all illegal real estate transactions...?

Then you clearly don't understand how VA law works. It's always referred to as a "good ole boys" network, and I'm not at all surprised that a special interest is being served here. Disheartening, yes, but a reality. If you were on Capitol Hill you would really shudder as to whom is being served.

Yes, Marilyn, I do understand about the good ole boy club...
I'm from Chicago remember? The city with big shoulders...and its WHO you know and not WHAT you know that gets one city contracts, etc.
What is amazing is the blatant disregard to the current mortgage crisis. If this law is passed, I'd bet my pretty little a$$ that this guy will be the first to not only profit from it, but eventually get caught up in some sort of fraudulent mortgage scam...and we certainly do not need that.
The fact that he owns an enotarization company is a big red flag for the potential of fraudulant transactions.
I'd say, you VA notaries really need to send a loud message to your legislature...send them emails, letters, phone calls...and let yourselves be heard.
...hmm...this will be interesting to watch.

including an eNotarization company,- how convenient!
Poor VA - you may be the testing grounds as that is when he/they need.
Notice all the FutureLaw people have the same goals - that RE Development project.

Good Grief! We have a perfect forum (NOTROT) from which to take a position with respect to e-notarization. There asre a lot good argument in here to argue against it. I agree will all of them! Should we pull our collective heads together and produce a position paper for our Congress men & women to read? Perhaps start our own lobby?

OMG - Cari this is crazy
Thanks for bringing it out about Chip Dicks' eNotarization company.
This news is most disheartening. I agree with you...where are the VA lawmakers' heads?

>>>The bill will enable businesses that handle large numbers of transactions, such as banks and mortgage companies, to use video images of documents and the people signing them, Byron said.<<<
Great... Make it easier for the big banks to robo-sign thousands of fraudulent documents with the click of a mouse. I'm glad the NNA is stepping in, and I hope they continue to try to crush this like the advocates they claim to be.
