Escrow saying customer forgot to sign
I did a signing on Tuesday for a lender. My printer printed the last 30 some pages in Russian. Which to me was weird, since it had never happened. I reprinted those pages and before I left for the signing, I double checked everything. Well at the signing, there were some documents missing the signature line and swapped with the customer copy.
Well this morning the escrow company calls me to let me know, there was some borrower signatures missing. I wasn't home, so I told her to email me the documents missing the borrower signature, I didn't understand how, since I always double check to make sure all signatures, initials and dates are there. I got home and checked my email, and I remember those documents being signed, since those were the ones that I had to swap, since they were missing the signature line. I spoke with the lender and told them escrow must of misplaced those documents, I knew she had signed them. Is my word against theirs. Escrow wants me to pay for Fed Ex.
I told the lender I would use my Fed Ex account. The lender told me not to worry about using my account and will have escrow use their account. She believed me and told me, that escrow company always has documents missing, since there's more than two people handling the same file.
I just can't believe how quickly is our fault. Is never escrow is always someone else

Sounds like it will work out ok for you. You are right, the notary is the easiest to pass blame to because we don't have a physical presence there, so we are the first on the list.

This is just an unorganized badly trained escrow person. Do not take it personally, some people cannot admit guilt or incompetence. Having been an escrow officer for over 30 years, and an escrow instructor for 15 years, I can tell that escrow officer had bad or little training with the physicality of loan docs. All they should be looking for in the package is the Note, Escrow Instructions, HUD, Notice of Right to Cancel and the Deed of Trust. The rest doesn't even have to be touched or copied! Also, the edict that only one person package the docs for the lender is very important. When I saw assistants/officers mix one file with another on their desk, I used to yell at them (my yelling, I am assured, is more like chastising). Better to be yelled at than misplace an important document! Glad the lender agreed with you.
