Dower and curtesy have been abolished in North Carolina. N.C.G.S. Sec. 29-4. However, spouses must join in all conveyances because of the spouse's marital interest in property. N.C.G.S. Sec. 29-14.

North Carolina is not a community property state.

Article X Section 2 of the North Carolina Constitution provides for a homestead as follows: ?Every homestead and the buildings and dwellings used therewith, to a value fixed by the General Assembly, but not less than $1,000 to be selected by the owner thereof...shall be exempt from sale under execution or other final process obtained on any debt?. Subsection 4 of Article X, Section 2, requires the deed made by a married owner of a homestead to have the signature and acknowledgement of his or her spouse.

A non-borrowing spouse must join in execution of certain docs for a loan on the homestead property in NC. The usual ones are DOT, TIL, Itemization, RTC. In addition, the non-borrowing spouse's name might appear on a Sig/Name Aff, Compliance Agreement, & Title Affs. Lenders are not consistent as to whether or not NBS must sign HUD.
