Still confused about nka

This still confuses me. If someone has to sign Jane Smith nka Jane Doe do I have to write all that in the venue? Or just Jane Doe. I write both names in there that they are signing with and have not had anything returned yet but, I still wonder.

Yes, IL allows for representative capacity

Since Illinois acknowledgments allow for the indication of a representative capacity (pg 14-15 of the IL notary handbook, 2010 ed.) it is proper to state "... by Jane Smith nka Jane Doe ..." Whether or not the TC or lender accepts it, is up to them.

You may want to check with your state's recording requirements. In my state the mortgagor's name as it appears on page one of the document, and the signature line and the notary's acknowledgement, must all reflect nka, fka's aka, etc. or it may be rejected for recording.

And in my day as the big bad recorder, that was the number one reason for rejecting a document.

Our handbook and our notary laws are pretty much crap. There is NO mention of AKA's, but I would ask the TC or your hiring party, how the signer should sign.

If she got married for example, what you wrote might be okay. But again, check with your hiring party.

And I think you're confused about the venue??
