When Your Commission Is Nearing Expiration....

....up to what point do you notarize? I've heard with notarizing adoption paperwork, it is requested that the Notary's commission have at least two years on it. What about loan signings and general notary work? Let's say your commission expires June 1st - do you take on loan signings or general notary jobs on May 31st?

At what point do you decline notarizing until you get your new seal? And what do you say to callers requesting notarizations? TIA

I started the renewal process several months in advance, receiving the new seal within a month of the old commission expiring. Thus I was notarizing up to my expiration date of Sept. 30, retired the old seal when I got home from the appointment, and started using the new seal the very next day on Oct. 1.

In Oregon, at least, commission is good until midnight

of expiration day. So, yes, May 31st would be my last day with that stamp. I decline notarizing if my commission is not current - expiration date is part of our stamp info.

As for some arbitrary "rule" about two years, I've not run across that, but can't see how that would fly, since the SOS operates under OR law. Here, we can't renew that early - term is for four years.

Same here...my commission expires 6/28

I can notarize up until midnight 6/28 - new commission is effective 6/29 and that's stated right on my commission certificate.

I was referring to adoption agencies...especially those overseas where Americans are adopting foreign infants - those agencies wanting the Notary's commission to have 2 years on it. For example, since my commission expires 9/7/2011, it would not be accepted by the agency - my commission would have to expire 9/7/ 2013 or later for the *agency* to accept it. Has anyone heard that?

If you notarize on May 31st and your commission expires June 1st and the TC gets the documents back June 2nd or 3rd, does the TC balk that now their docs have an expired commission seal on it?

Why would they balk Lisa?

The commission and seal were in effect the day of the notarization. If they balk then they need to be educated a bit more..

Why? The date on the cert is prior to midnight of the

expiration? Docs recorded 10 years ago (or however many) have expired seals - it doesn't nullify their notarizations.

True.....just wondering how many have the seal expiring a day or two after the notarization. I know it's all legal - just seems weird...or maybe *I'm* weird - or a little of both!

Except for international adoption - or other international work, including anything that might need an apostille - I think you're good up until midnight of the day the commission expires. After all, that's the definition of "expiration", right? Wink That's what I've always done. Once that day is over, that's when the new commission number goes into affect and that's when I destroy the old stamp and begin using the new one.

As for the international stuff, I believe that's going to vary from country to country and it's a good idea to ask the person requesting the notarization to confirm. I've heard one year from some, two years from others, and I think even six months one time. For routine stuff, this doesn't even come up in conversation.

China, Russia, Katzitlan (sp) and Guatemala the notary commission must have at least one year left at the time the docs are notarized. I have never heard of a 2 year out commission requirement.

My last commission expires 2/21/2011 but I reapplied and my new commission is 2/21/2017 and I received the notfication a few weeks ago. I began using my 2017 expiration as soon as I got back from Staples with my new Brother stamps. Technically, the old commission in not yet done, but since the state's website reflects my new commission date, I'm going with that and now I can offer my international adoption services again, I did stop a year ago, due to the expiration date that would happen.

your commissions don't have effective dates?

Here in FL, every time we renew we have a new commission number AND a new effective date - my most recent commission runs 6/29/2010 - 6/28/2014.

I just looked at my new card, it says appointment date 1/12/2011 and expiration date of 2/21/2017.

However, my old card has an appointment date of 12/29/2004 and an expiration date of 2/21/2011 as we have 5 to 6 year commission expiration dates. Our old commissions were just a certificate with the expiration date.

However, my new expiration date was entered on the SOS website BEFORE I received the wallet card in the mail and if someone looked me up, it would have shown my new expiration date before I even was aware of it.

If one is already a Michigan notary, we don't "reapply" the state treats every notary application like a new one. My old bond and e & o is good through 2/21/2011 but my new bond and E & O overlap. Not a big deal. I just like the Brother stamps so much, I wanted to begin asap! LOL

In Virginia the dates may overlap between the old and new commission. When I renewed my Virginia notary commission in 2009, I had an overlap period of 32 days. Upon receipt of my new commission certificate, I ordered two new notary stamps but continued to use my old stamp (still valid) until my new stamps arrived. Once the new stamps arrived, I began using my new commission/stamps. Same commission number on both.

Forgot to say that I stopped using the old stamp once I began using the new.
